No Shame Over Bogus Eli/New Hill Subscriptions

I'm occasionally accused of focusing too much on the minor sins of the technology giants instead of exposing more of the outright scams perpetrated by lesser-known companies. And there might be something to that criticism. But one reason I lean that way is that at least the Microsofts and HPs have enough of a sense of shame that they will try to fix some of the problems we air. That doesn't tend to be true of the shadier outfits, such as the Eli Journals/New Hill Services publishing operation.

Several months ago I wrote about one reader's experience with invoices for an Eli Journals publication that he never ordered. Each letter demanding $97 for 'Inside Adobe Indesign' was more threatening than the previous invoice, but the reader could not get Eli/New Hill to stop sending him the invoices or the unwanted publication. "I spoke at length with a customer service representative who assured me that the matter would be corrected and I would have no more trouble from them," the reader wrote me a few weeks after my story appeared. "But then I got yet another invoice from them, saying menacingly that they 'certainly do not want to take any further action to collect these funds.'"

I have now heard from a number of others who have also received multiple invoices for various publications from this group. They are all certain they never subscribed to the publication and most suspect the first reader was correct in surmising that Eli got his address from his personal website.

"I've been having an experience similar to your reader who first received invoices for a publication he didn't order from Eli Journals/New Hill Services, and then started receiving the publication itself," one reader wrote. "In my case it's 'Inside Photoshop.' How did they know that I use Photoshop? Probably from my website, although in fact I'm an experienced Photoshop user who feels no need to spend $97 for an overpriced subscription to their newsletter. I've e-mailed and snail-mailed them several times, reiterating that I didn't order their publication and that they should stop bothering me, but the invoices just keep arriving. I'd like to just ignore them, but is there some way that they can mess up my credit rating with this wretched behavior?"

While it's highly unlikely that Eli/New Hill could or would cause trouble for anybody's credit for these letters that the company itself claims are merely "an offer to subscribe," you can't blame those recipients who get nervous about the incessant threats. "I get faxed at least three times a week from them for a dental coding book, price $650.00," another reader wrote. " I used to get at least three mailings a weeks as well. It seems they got ahold of the American Dental Association's membership book. When I contacted them and asked for my name to be removed and said I hoped they would be closed down, the worker replied that she did not care if they were ripping people off or not. Nice, huh?"

That reader isn't the only dentist to be bothered in this way, as can be seen by this American Dental Association article. Indeed, it would appear that, along with technology publications, medical publications are another major focus for Eli Journals, aka New Hill Services, aka The Coding Institute, aka National Subscription Bureau, aka National Litigation Bureau, aka Orthopedic Coding Alert, aka Eli Research, etc. And yet another reader notes that this multi-named "publishing" organization appears to have have already run afoul of at least one state attorney general.

But there might be other good ways to cause old Eli and friends a bit of consternation. A number of readers have noted that under U.S. postal regulations, you are allowed to keep with no obligation anything sent unsolicited to you in the mail. And the laws against mail fraud provide an avenue that one reader believes was effective in getting Eli/New Hill to stop sending its phony invoices to him. "I got a couple of bills from those lowlifes," he wrote. "I don't know if I even got the publication they were talking about, but I know I didn't ask for it. So I went to the USPS's online complaint form for mail fraud [Ed's note: Please do not use the postal service's mail fraud form to complain about any company that has not victimized you personally] and filed a complaint against them. The billing stopped soon thereafter."

For several months, I've received annoying, threatening invoices for SQL Server Solutions, which I neither wanted nor ordered. I don't know how they got my name, except that I had recently taken an SQL Server class and visited a bunch of sites pertaining to that topic. My theory is that this technique might work as "invoice spam." A certain percentage of these invoices might just get paid, especially if the person doing the paperwork is distracted or procedures are a little loose. I returned the invoices with a note to cancel the subscription, but they kept coming. So, I called their customer service number and had them cancel my subscription. No fuss, but it's too soon to know if that worked, since it's only been two weeks. I like the idea of reporting them to the Postal Service.

I think your theory is correct regarding 'invoice spam'.  

Studies have shown that you can run an ad in the classifieds section of a newspaper, to the effect of "Don't miss your chance!  Send $5 today to Box 999, Traverse City, MI" etc., and even though you promise nothing in return, a certain percentage of readers will comply...

I got another dunning invoice today. It warns me that my "account is about to be suspended." Like I believe that, or care. I'd hoped that the phone call to cancel would do the trick. In spite of what Jermaine told me, I'm not canceled. Neither the call nor regularly returning the invoices marked "cancel" has worked. I see below that other people have tried faxing, only to have the fax not go through. Ironically, I also got a renewal notice today, suggesting that I "lock in huge savings."

I maybe incorrect, here, but I'm relatively sure that if you receive something via USPS, which you neither requested, authorized nor ordered, you are free to keep or dispose of it, with no obligation. While refusing the item might be the "right thing to do", I seem to recall that you are under no obligation to do so. Were it I in this situation, I'd simply return the invoices, letters and newsletters/magazines, marked "return to sender".

But following the sending of unsolicited merchandise with invoices demanding payment, or "subscription offers" that appear to be invoices, would almost certainly be mail fraud.

I get fake invoices every year for bogus yellow pages listings. the fine print on the document says that it's not an invoice but an offer to order an ad. It looks exactly like an invoice and it even says "INVOICE" on it.

You really have to watch these scams.

Threatening Letters from Eli[ Reply to This ] (none / 0) (#4)

I made the mistake of taking a trial subscription from Eli Hill for several newsletters. It does not seem to matter how many times you send them a "cancel" notice in accord with the terms of the offer -- they sending you increasingly threatening billing notices. I figure my next step is to send these to the Illinois Attorney General along with a copy of your column. It's most likely that it will take legal action to stop these crooks and few state attorney generals can resist the opportunity to put a halt to these kinds of practices -- I hope.

I am glad to know that I am not the only one being harassed by the Eli folks. They continually send me bills, sample copies, and offers to subscribe. Some weeks I'll receive a communication every day. Sometimes more than one offer per day. I also get offers at home. They also send me emails and have occasionally called, both at home and work. These people should be sued just for wasting everyone's time.

The monthly magazine Harper's has a subscriber alert warning in every issue and on their web site that states: "It has come to our attention that several of our subscribers have received renewal notifications from an independent magazine clearinghouse doing business under the names Magazine Billing Services, Publishers Processing Services Inc., and American Consumer Publish Assoc. These companies have not been authorized to sell subscriptions on behalf of Harper's Magazine. We are making efforts to locate each of these companies, but unfortunately they are difficult to find."

I've gotten these 'third party' invoices for car mags, science fiction, mags, etc. Now I don't even open them, but just trash them. If it's not from the publisher, just throw them out. You can't be sure any of the money will get to the real publisher, and even if it does, you've encouraged the third party leeches.

I've been getting several of these invoices after legitimately trying a sample issue. As a courtesy, I took the invoice, wrote "CANCEL" across the body with a fat Sharpie, and tried to fax it to the number on the invoice. Every time it went tried, it came back with a "bad line" failure. The next month, tried to CANCEL and fax again, and again "bad line". Tried it this month - still "bad line". At this time, I feel I've fulfilled my obligation as one who wanted to try a sample issue, since they obviously either don't want to fix their fax machine or they deliberately leave it broken.

As IT Manager in my last position, the web marketing manager asked if I could do anything about threatening letters she was getting for payment on a bogus "online directory listing" she had never signed up for.

These guys were very agressive but I believe several phone calls and faxes finally got rid of them. What a huge waste of our resources!

I subscribed to a publication years ago but decided to let it lapse. About a year later I started getting the invoice "renewal notice." That was about 18 months ago. Initially got between 4 and 7 a month. I've simply ignored them all. Currently get about 1 every 3-4 weeks, started saving them in a folder just for fun.
