Spy Act Only Protects Vendors and Their DRM

Here we go again. Congress has decided it needs to protect us from spyware, but - surprise, surprise - the bill they are most seriously considering actually offers no help in that regard. What's worse, the bill seems designed to make it harder for you to legally go after those who spy on you, particularly if they are doing so to determine if you're authorized to use a software product.


Last week a subcommittee of the House Committee on Energy and Commerce approved H.R. 964, the Spy Act, which bans some of the more blatant forms of spyware such as those that hijack computer or log keystrokes. The bill now goes to the full committee for approval, and it's expected to move quickly as it has strong bipartisan support.

But why? There are already plenty of federal and state laws regarding computer fraud, trespass, and deceptive trade practices that make spyware illegal. The existing laws have been sufficient to allow the FTC and/or state attorneys general to even successfully go after some of the nastier adware companies like Direct Revenue and Zango/180 Solutions. So what is the purpose of this law?

A clue can be found in the Limitations section of the Act, which features this rather broad exception:

Exception Relating to Security- Nothing in this Act shall apply to--
(1) any monitoring of, or interaction with, a subscriber's Internet or other network connection or service, or a protected computer, by a telecommunications carrier, cable operator, computer hardware or software provider, or provider of information service or interactive computer service, to the extent that such monitoring or interaction is for network or computer security purposes, diagnostics, technical support, or repair, or for the detection or prevention of fraudulent activities; or
(2) a discrete interaction with a protected computer by a provider of computer software solely to determine whether the user of the computer is authorized to use such software, that occurs upon -- (A) initialization of the software; or (B) an affirmative request by the owner or authorized user for an update of, addition to, or technical service for, the software.

In other words, it's perfectly OK for basically any vendor you do business with, or maybe thinks you do business with them for that matter, to use any of the deceptive practices the bill prohibits to load spyware on your computer. The company doesn't have to give you notice and it can collect whatever information it thinks necessary to make sure there's no funny business going on. And by the way, another exception provision specifically protects computer manufacturers from any liability for spyware they load on your computer before they send it to you. Of course, the exception for software companies checking to make sure you're an authorized user is the strongest evidence of what this bill is all about. After all, in terms of function, there's not much difference between spyware and DRM. Too bad for Sony this bill wasn't already the law when its rootkit-infected CDs came to light.

Another disturbing aspect of the bill is its enforcement provisions. The bill very specifically pre-empts all state laws that regulate "unfair or deceptive conduct" similar to that covered by the Spy Act. Now, the state spyware laws are pretty useless anyway, so that may not seem like a big problem. But the bill vests all enforcement power in the FTC and says that "no person other than the Attorney General of a State may bring a civil action" under the law. Private rights of action under state consumer protection laws are eliminated. So if you're victimized by a spyware-like deception and want to sue the perpetrator, you've got to talk the FTC or your state attorney general into taking up your case.

Let's sum up. If the Spy Act become law, hardware, software, and network vendors will be granted carte blanche to use spyware themselves to police their customers' use of their products and services. Incredibly broad exceptions will probably allow even the worst of the adware outfits to operate with legal cover. State attempts to deal with the spyware problem will be pre-empted and enforcement left up almost entirely to the FTC. Gee, what's not to like in that deal?

If Congress' approach on this sounds vaguely familiar, it should. It's basically the same formula Congress adopted four years to deal with spam. As we know, the dreadful Can Spam Act of 2003 proved to be the "Yes, You Can Spam Act." If wiser heads in Congress don't prevail - and who knows if there are any - I fear the Spy Act of 2007 will just prove to be the "Vendors Can Spy Act."

AFFECT, the anti-UCITA coalition of which I'm a long-time member, is concerned about H.R. 964. They are worried in particular that the exception I've re-produced above could be a back-door way of granting the IT industry to right to electronic self help to disable customers' products. You can learn more about AFFECT at their Fair Terms website.

Of course, another good way to make your voice heard is to contact your Congresspersons and tell them you oppose the Spy Act.

... that one of the principle users of this act will be the big media companies, in their ever-expanding quest to enforce copyrights and kill filesharing. It appears that this act makes it entirely legal for any entertainment company to load your PC with spyware, so they can monitor and report your uses (legal or not) of their products.

Another obvious next step is to couple such spyware with software that enforces pay-per-use, even of purchased CDs and DVDs.

I share Ed's skepticism of the Spy Act.

Notice that the current H.R.964 substantially unchanged from the 2004-2005 H.R.29. In 2005, I posted a tough critique of HR.29. See What Hope for Federal Anti-Spyware Legislation?. I flagged the weak enforcement problem (as Ed notes in his sixth paragraph), along with lax substantive provisions.

Tellingly, security vendors and consumer advocates aren't lining up in support of H.R.964. Meanwhile, spyware makers seem to like it fine. Indeed, Zango lawyer Christine Varney testified in favor of the bill last month.

Zango likes the bill. Ed and I don't. This speaks volumes.

"...the software developers should be held accountable -- legally and financially -- for the prohibited actions of their affiliate business partners."

No, no, no. The ones to hit are those paying for the advertising in the first place. Without someone to sell advertising (ie. your eyeballs) to, there's no money in it.

Because so long as the business model makes money, new junkware developers and purveyors will always spring up to fill the gap left by those run out of business. But make this type of "advertising" too costly to any legit businesses paying for it, and it'll stop. (Obviously, fraudulent businesses won't care.)

As a meatspace parallel -- if a car dealership runs ads that falsely describe used cars as "new", they get fined, not the newspaper who ran the ad. This is the only reason papers aren't overwhelmed with crap ads. (Tho some companies still try to get away with it.)

One of the challenges of fighting spyware is that so much of it is done "with permission." When you "agree" to the terms of a website or a software product, the contract may have surprising terms, including permission for the vendor (or a third party) to access your computer, read your data, send messages from your system, and so on. To the extent that clearly-unreasonable clickwrap terms are enforceable, a wide array of spyware distributors and system hijackers will have free reign, far beyond the reach of statutes like this one. -cem kaner

..nor does it help that the only guaranteed method to avoid clickwrap of any kind is to only use software - OS, Applications, Compilers, Etc - that you write yourself. So where does that leave endusers like myself? With two choices: a)put up with the clickwrap terms and accept spyware as a cost of productivity and b) Reject the Borg - Become a Luddite for Life. I truly wish a stronger stand had been made for end-user rights 20+ years ago, before clickwrap, spyware, DRM, and overblown EULAs became so pervasive. Mr. Kaner has made the point in other places that in certain industries comparable policies simply would not stand, and the consumer would have recourse. If you buy a car and a manufacturer's defect causes it to break down on the way home, you have recourse. (Normally not only for the vehicle itself, but also for damages to you or any belongings you had within the vehicle.) If you buy software and a bug causes it to wipe out every other application on your computer during the install, tough luck. At best, you may be eligible for a refund of purchase price or a replacement of the software that caused the failure. In some cases, it's entirely up to the vendor or developer to determine whether the issue is even considered a bug or a feature. That's not right, ethical, fair, or reasonable - but it is the result a string of poor decisions over the years.

There's (c) Use Free Software.   The GPL is not an EULA, it's a distribution license.  You can make sure (either by yourself, or have a qualified person do so) that there's none of the crud that you hate in it.

And for those who say that not everyone can check the source of GPL code, I'd like to point out that while I would hire a qualified professional to do work on my home's electrical system, there's nothing preventing me from doing so myself -- I just lack the knowledge.  Same thing with GPL.

Free mean "freedom" not "free beer".

1. You can consider the motives of the people writing your software. Microsoft has every incentive to spy on you, and has openly said they plan to do so. Open-source stuff has a huge advantage on this issue.

2. Audits by other people. Even if you do not read the source code of all the Linuxy software, rest assured that other people are doing so. This is not true for Windows, where the only people reading it are Microsoft employees.

3. Sandboxes. Better operating systems could provide sandboxes. Right now, every plugin or application runs with the full rights of the user who installed it. A better OS can give limited access to the third-party item.

No OS I know is good at this last item, but it is something to keep your eyes out in future offerings. I would guess Linux has the better starting point, because it is smaller and more principled, but it certainly isn't there right now. Apps do not run as root on Linux, but they do have full permission to access your entire home directory.

I love how all these vendors of software and IP like to say "it's our property, not yours--you only bought a license for it".

Let's turn that around and say "It's MY computer, not yours--I only granted you a license to install what I specifically authorized you to install, and I may revoke that license in whole or in part at any time. If that license is revoked by me, you are required to destroy all copies of what you installed immediately".

In this age of sneaky sneakwrap EULAs, that may be a pipe dream. But we can call the principle "NYFC"--Not Your Friendly Computer, or something like that.

Or we might call it privateering. In the old days countries would sometimes outsource their naval operations and split the loot with the privateers. Seems to me this what the biz-gov partnership can do. Biz can spy on consumers for commercial marketing data & the government can use the same agents for surveillance without warrants. Who's to know?
