Opting Out From 3Com Spam Requires Opting In

Under the horrendous Can Spam Act, anyone can continue to send you unsolicited e-mail until you follow that particular spammer's designated opt-out procedure. But what are you supposed to do if the spammer's opt-out procedure requires you to give them more information about you, and to agree to let them continue spamming you? That's what one reader and I were both left wondering after he discovered that 3Com seems to have set up its opt-out procedure just that way.


"I got a bit of spam from 3Com today, which would not be noteworthy except that the 'unsubscribe' page really made me mad," the reader wrote recently. "It wouldn't just let me unsubscribe my email address -- it demanded my name, company, and zip code. And it says by submitting that information, I'm consenting to let them use it in accordance with their privacy policy."

The reader doesn't know how 3Com got his e-mail address, although he suspects it may have been from one of the many trade publications he subscribes to online. The e-mail, which promoted 3Com networking solutions, stated at the end of the message that:

"If you do not wish to receive future e-mails from 3Com click here: http://www.3com.com/solutions/en_US/3com_updates.html. If you do not follow these directions your name may not be suppressed from future 3Com e-mail campaigns."

When the reader clicked on the unsubscribe page link, he was presented with a web form with required fields for first name, last name, e-mail address and zip code, plus an optional field for company. Below that the web form stated:

"By submitting the above details to 3Com and proceeding with this activity, you consent to the collection, processing and use of that data in accordance with 3Com's Privacy Statement available for viewing at www.3com.com/legal/privacy.html."

Of course, the privacy policy that 3Com cites allows the company to use any information you provide them to contact you with marketing offers from 3Com or any of its "business partners." In other words, 3Com's opt-out procedure winds up forming a nice little circle. In order to opt out, you have to agree that 3Com can choose to opt you back in.

When confronted with the unsubscribe form, the reader had decided to go ahead with the opt out, using phony information for all the required fields except the e-mail address. "I don't bother doing this with the fly-by-nighters, of course, but I would expect a company like 3Com to actually honor opt-outs," the reader wrote. "Maybe I was wrong. When I clicked submit it said 'Thank you for the information.' Lucky I just made stuff up. But it's just goofy -- does the law somehow allow them to do this 'infinite opt-out?'"

Good question. And it's probably a good bet that the answer, at least as far as the Can Spam Act is concerned, is yes. Hey, all that 3Com is doing is getting what Can Spam calls "subsequent affirmative consent" -- permission to keep on spamming you after you've opted out. After all, just because you never asked a spammer to send you e-mail doesn't mean you should have the right to make them stop. That's the attitude the U.S. Congress had when Congress passed the Can Spam Act, and, sadly, it seems to be the attitude 3Com has now.

I make it a general rule to simply block all spammers. Far too many of them use the opt-out process to verify that a live address has been reached, leading to more spam. It is far better to automatically route them to the trash.

The anonymous comment I am responding to is useless.

"Far too many of them" he asserts. But he does so without any data. Is this a confirmed fact, or an urban legend he is propogating. We don't know. And his comment does not help us learn in any manner.

It is a confirmed fact that unsubscribing only gets you more spam. It's been tested time and again: create a throwaway email account and don't reference it anywhere. Wait a few weeks. It should be free of spam. (If the account is getting spam at this time, and you didn't give out the address at all, the throwaway provider must have; ditch them and find another.)

Now, the next time you get a spam at your regular email, copy the unsubscribe address. Send mail from the throwaway account to that address with "REMOVE" in the subject, just as the spammer instructed. Come back in a week and witness an inbox chock-full of special v1agra offers, online p0ker tips, and 419 scams.

Any remaining doubts you had about what "remove" addresses really do should be gone after that.

Just because your unused, unreferenced e-mail account gets spam doesn't mean that the provider provided it. Spammers have become very adept at creating software which puts together common strings of text in order to guess if an e-mail address is valid/active/legitimate.

From the ever-popular johnsmith@something.com to the slightly more ambiguous jsmith2003@something.com, or even more rediculous strings like heartthrob384938@something.com, it doesn't really matter as long as it is somewhat logical.

I think at this point the only way you could guarantee that a naked, unprotected e-mail account could not receive spam is if you used a very randomized order of letters and numbers.

I have no idea how one gets the CanSpam Act enforced. But I suspect if 3Com got a letter from an appropriate government authority saying they are under investigation for this policy being in violation of the Act, the policy would change within 24 hours.

Regardless of what the Can-Spam Act says, users have a right to find spam annoying. When a known company (such as 3Com) plays stupid with their spamming tactics, we just do a blanket block of their domain at the gateway, which blocks all their spam. Of course, this also blocks all their legitimate emails, but why would I want to do business with someone who does not respect my privacy?

Using a throwaway account to unsubscribe, when you have to provide name, address, etc. just give them the appropriate data for your congressman (or congresswoman). Pretty soon congress would really want to get rid of spam.

congressmen block email. what many of them do is NOT have an email address (unless you dig deep enough) - many have fill-in forms that are voluminous to fill out, not a straigt email address. thus, they keep insulated from what they propagate upon us peons.

An early website of the DMA (circa 2001) had all the officers and adminstrative staff's email addresses listed. At the time, this was very usefull to allow a person to opt out of spam offers by inserting one of their addresses. They probably got way too much spam and so now the addresses are generic. Funny thing was that the DMA did later (2003ish) come out against spam...

I just went to the 3Com listed in the article which brought up an unavailable page notice. I then spotted what looked like a stray period at the end of the address and removed it. I then got a simple enter your email address and click submit unsubscribe page. Has 3Com changed something this quickly?

When I have excess time (ha ha), and I want to lose a particularly irritating spammer - I navigate to their change preferences page, and change my email address to something like nowhere@anything.com. Also, the free email accounts make a good "spare" when you NEED to give a real email address, for one time registration deals, etc. NEVER give out your primary email address! Indeed the opt-out options, simply make your address MORE sellable - as you identify 1. your email address as real 2. yourself as someone who will do "something" I guess if they follow anykind of ethical standard, you may stop getting mail from xyz.com, only to get more from 123.com, abc.com, etc...

for this type of thing is http://www.sneakemail.com . They offer free and paid services that allow one to create different addresses for each entity that one emails yet have all the replies forwarded to real address(es) of your choice.

This is quite cool in a number of ways. One by tagging each address, you know *exactly* who sold or lost control of your address. Second you can change the real email address these go to quickly, so if you change email providers, you can redirect all your mail in just one step instead of having to notify a bunch of different people or companies. They also offer a number of options with incoming mail, all the way up to, and including, bouncing it back to the sender.

Disclaimer: I have no affiliation with Sneakemail other than the fact I've been a very happy, paid member there for over 5 years. Their free service is good, it's simply limited in the amount of mail you can receive per month. The paid service (only $24.00/year) raises that limit quite a bit.

If you want to avoid spam, and find out who sells your email address, Sneakemail is a fantastic tool! I can't praise Sneakemail highly enough.

That limit sounds like it could be a problem. A particularly heavy spam barrage would exhaust it and then you're screwed for a month.

With my paid account I get 150 MB/month, so I've never had a problem with hitting any limits. I think the free accounts are limited to 10 MB, so it could be a problem on the free accounts with a very heavy barrage.

There are ways to control even that situation however. Once you start getting spam to any particular address, you have the ability to handle incoming messages by rules, bounce or shred messages entirely (uses 1/2 bandwidth), deactivate the address (uses no bandwidth), delete the address etc. There are numerous ways available to help preserve bandwidth during a barrage.

For what I use Sneakemail for, mainly tracking who sells or loses control of my email address, protecting my real addresses from spammers, it works very, very well and is worth much more to me than the <6.6 cents a day I pay for it. :)

Might I suggest SpamGourmet.com? They offer free disposable email addresses that you can "tag" to identify recipients of specific addresses and limit to a certain number of emails. The addresses are redirected to whatever "master" account you specify, and you can reply directly to messages sent to them and have your "real" address automatically replaced with the disposable one by SpamGourmet.

And if you really want, the source code for this service is all open-source, and you can download it from their site and set up your own disposable email server.

I've been using them for years and have never had a complaint.

I don't know how they got my email address but they started sending me status updates on my mortgage. I protested over the phone multiple times but the spam kept coming. Then the can spam act was passed and I noticed that the only way to opt out of the messages was to sign up for an online account with them (something I had/have never done). In the process of signing up for an online account (for the purpose of opting out of the spam) they make it clear that they will continue to spam you anyway and that their affiliates will pile on also!

I actually have a 2nd mortgage with Countrywide and yet they STILL phone-spam me with offers and will not take no for an answer. My request, demands, pleads to be placed on the do-not-call list were ignroed. I finally got a 'manager' to 1) add me to the do not call list (or so she claims), and 2) send me an email to a special email trap addy (countrywide@<deleted domain name>.com), clearly stating that I'd been added to the list. I kept her butt on the phone until I received it in the inbox. Any spam coming to that particular email address, and I'll know where it came from and will at least have 'some' "evidence" to use in court. My advice to all is NEVER, EVER do business with Countrywide!

The leading comment in Ed's original article set the tone for too may of the comments. It and some of the comments seem to imply that something fundamentally wrong (spamming) may be OK as long as it doesn't violate one horrendous law.

However, the very idea that the youCANSPAM act legalizes anything is wrong. The companies who spam cannot use it to insist their spam is OK.

All the youCANSPAM act does is make some types of spam explicitly illegal. That doesn't make other types of spam somehow OK, let alone legal under other statutory laws or common law.

If the email is unsolicited (not knowingly and deliberately requested) and is sent in bulk, it's spam regardless of youCANSPAM act compliance.

3Com, Countrywide, etc. are all deliberately and maliciously spamming.

I ran into this same practice for another company when helping my sister clean up her email. I entered "Noneof" and "Yourbusiness" when promped for a name. Other supposedly reputable entities - like a Republican Party news service - simply had a dead link to the unsubscribe service. So I had to block the domain altogether. Sorry, Elizabeth Dole ...
