SMS Spam With a Sneakwrap Twist

SMS spam on your cell phone is annoying enough as it is. Imagine how much more annoying it is to discover that some of the text messages you ignored may have been sneakwrap-type notices of charges for a service you didn't sign up to receive. That's what happened to one reader recently with an outfit called Dadamobile.


"I recently found a charge on my Cingular cellular phone bill for $9.99," the reader wrote. "The line item on the bill was for e-wallet services and the company referenced was Mblox.com. I sent an e-mail to Mblox and received a response stating that they were simply a middleman and that the charge came for a company called Dadamobile.com. I had never heard of the company. My next e-mail went to Dadamobile."

In response, the reader received an e-mail from Dadamobile claiming his cell phone had been subscribed to their service a few months earlier, and they had started charging the $9.99 monthly fee only after his one-week free trial had passed without a cancellation from him. The act of subscribing "was done by visiting our website, inserting your phone number and ticking a box to state you had read the terms and conditions," the e-mail from the DADAmobile Customer Care Team read. "We have done a check in our database, but we did not find any requests to stop the service before the end of the free week. Afterwords (sic) you received several sms on your mobile which reminded you of the conditions of subscription and how to discontinue it:

'Need new hot content 4 ur mob? Check www.dadamobile.com or txt LIST to 63232.U have 40 downloads for $9.99/month only. 2 cancel txt STOP.Help?info@dadamobile.com.'"

Gee, that certainly strikes me as much a binding contract as some of the things our courts have upheld in recent years. Anyway, Dadamobile said it would now cease charging the reader, but that it didn't matter whether he personally had intentionally signed up or not. "Unfortunately Dadamobile can not take responsibility for the circumstances in which you subscribed, be accidental or not (sic)," the e-mail said.

The reader knows for certain that he didn't sign up at Dadamobile's website, accidentally or not, but it sounds like it doesn't matter to Datamobile if someone else did so with his cell phone number. "In other words, you get to go to the Dadamobile site, type in a cell phone number, and if the person didn't get the cancel SMS messages or just ignored them, they would be charged for the service," the reader wrote. "I did not subscribe to this service, and I have never visited their website. I am in the process of having Cingular reverse the e-wallet charges. The $9.99 isn't a large amount of money, but the way Dadamobile does business ticks me off. If I would not have noticed it right away, who knows how long they would have continued to charge my account?"

The reader doesn't remember seeing the SMS messages that Dadamobile claims it sent him, but he says it's possible he just ignored it as spam. "To be honest, I may have gotten the messages," he wrote. "But since I don't typically use SMS, I would probably just have deleted them. I did send them a follow-up e-mail suggesting that their business practices aren't very good, but they didn't respond to that one."

On its website, Dadamobile encourages any and all to sign up for free to be a Dadamobile affiliate and earn $6 or more for every new subscriber they send company's way. So, far from being an accident, it's quite possible someone was just trying to pick up a few easy bucks by subscribing the reader's cell phone number. And we might suspect that Dadamobile's disavowal of all responsibility for how you were signed up or by shows it has no qualms about "accidental" subscriptions faked by its affiliates. "I find it interesting that they can place a charge against your cellular account without any sort of authorization whatsoever," concludes the reader. "It seems like a classic case of opt-out."

A recently signed federal law makes virtually any internet communication sent "with the intent to annoy" punishable by fine and/or 2 years imprisonment... While proving intent will be difficult... I believe, this is one of the very few "good" uses to which the law could be put.. assuming its actually constitutional... Obivously, I'm being facetious... but the law just might put a scare in some these spammers while it lasts.

On a purely philosophical level, default opt-in to pay is just plain morally wrong. We don't accept it from spammers over being added to their lists. Dabamobile is counting on the likelihood their message -- ambiguous at best -- will be ignored. If such things as this are upheld in court, it tends to justify those people who "go postal". It doesn't matter what courts say; people can discern injustice.

I just descovered they (dada.net) did the same thing to me, never been to there site, never even herd of them, but got the crap they spew out to my mobile phone, which, just as the person in your article,passed off as spam. Then came the $10 charge on my bill, Pisses me off the arrogance they have to assume that I would just pay them. I'm 55 and have no intrest in their crap,ringtones and wallpaper for my phone, did I just say that, $10 a month yo have them send me the latest rap-crap to my phone? Unbeliveable. Only in America. I intend to file fraud charges against them if they don't stop, and refund the $, which I have not yet paid.

I am the CEO of a public corporation - it has been brought to my attention that one employee has charges totalling $100 per month from Dada Mobile/Mblox (and a couple of similar companies)on a mobile phone owned not by him but by the corporation (and ultimately the taxpayers). So obviously Dada/Mblox do not care who owns the phones that they count as "subscribers", and have no proper systems for checking whether the transactions are authorised. Unfortunately for the employee concerned, state laws here require me to report this matter to the Corruption and Crime Commission. The employee concerned will probably lose his job, and may well face prosecution (that will not be my decision). I'd like to know what Dada/Mblox have to say about that . . .

Copy the emails, and send them to your state attorney general with a concise list of reasons why you think this is illegal. Also include contact info for the offending company. Most AG's will be quite diligent in following up on something this blatantly wrong. Sending emails and SMS messages does not constitute legal notice of anything, unless you've previously worked out some way to supply them with a digital signiature on electronic communications.

Cingular does do a lot to help customers who come with this complint, plus they have a purchase blocker feature which blocks any and all "ewallet" deals from pooping up on the bill out of nowhere...

I represent DADAmobile.com and would like to shed some light on some of the points discussed above.
First of all please let me explain exactly what our service offers to subscribers and how it is structured.
DADAmobile is a mobile subscription package billed to subscribers on a monthly basis at $9.99. Subscribers are billed by means of premium SMS.
The value proposition of the service is to provide subscribers with access to a wide range of mobile content (i.e. ringtones, real tones, wallpapers and javagames). With the payment of the monthly fee, members' accounts are credited with a sum of tokens (the amount of which depends on the user's carrier, i.e. Cingular users have a monthly allowance of 40 tokens) which they can "spend" by downloading content from the web site us.dadamobile.com.
The subscription to DADAmobile is a two-part process. First, the user inserts their mobile phone number on a web page on us.dadamobile.com. Second, after receiving an SMS reply from DADAmobile, the user confirms their subscription by either inserting a password (received in SMS) on the web or by replying YES via SMS from their handset. The user is ONLY subscribed to the service if they have completed this second step confirming that they wish to go ahead with the subscription.
This "second opt-in" ensures that users OWN the mobile phone number that has been inserted on the first page and that they have the handset in their posession when subscribing. Therefore no third-person number can be subscribed to DADAmobile unless they have permission to use that mobile/ mobile number and as a result can confirm the subscription as per step 2.
The "second opt-in"message the user receives also serves another purpose. It reminds users that they are subscribing to a monthly subscription service and gives them details on how they can, if they choose, opt-out and receive help. All this information is also clearly presented in more detail on the us.dadamobile.com website.
This two-step process makes it very difficult for us to understand how a user can subscribe without knowledge of doing so and how the word SPAM might be associated with our service.
It is in our interest to ensure that DADAmobile is a transparent service that offers real value for its customers so that they will remain with us and be happy to make use of what DADAmobile has to offer. Let me add DADAmobile is fully compliant with the Mobile Marketing Association Best Practices (<http://www.mmaglobal.com/bestpractices.pdf>).
In any case, if a user is dissatisfied with the service or if they simply change their mind, to opt-out from the service is very simple and can be performed by sending the keyword "STOP" via SMS to 63232 (END, QUIT, USUBSCRIBE are also valid), or by sending an email to info@dadamobile.com or by calling our toll-free number. Once a user has cancelled their subscription they will receive no further billing messages from us.
DADAmobile has also adopted a refund policy to reimburse unsatisfied users (e.g.. users that after subscribing understood that their handsets are not able to download products that they subscribed for).
Anyway if the user that triggered this thread would kindly provide us with their mobile number we can investigate their case further and will evaluate the refund of monies spent with us. Just send an email to info@dadamobile.com with GripeLog in the subject.

Anytime that a company starts off describing its "product" or "service" with jargon like "value proposition of the service", you can pretty much rest assured that it's crap. A company providing a service or product which was truly worth something wouldn't need to call attention to that fact.

Nor would I think a reputable company selling a truly "valuable" service even consider typing "yes" to a juvenile-worded SMS message such as "Need new hot content 4 ur mob? Check www.dadamobile.com or txt LIST to 63232.U have 40 downloads for $9.99/month only. 2 cancel txt STOP.Help?info@dadamobile.com" as constituting a valid acceptance of a contract. The message seems to both offer the service, AND tell the subscriber he's already on it (and if he's already on it, why would you ask him if he needs content?). And as one user already pointed out, by putting the cancellation information at the end of the message, it ensures it will be the first text "cut" if the device won't display it all.

If this is an example of "best practices" by mobile marketers, I'm further convinced I don't want ANYTHING marketed to me via my cell phone.

We don't care what your service is. We don't care what your policies are. We don't care if you think you are right and we don't care if you think your legalese protects you.

What we do care about is that you wrongfully charged an individual for your "services", and when you were informed of the problem you failed to take any steps to correct the problem.

Hopefully this individual will haul your rumps into court if Cingular doesn't take care of the problem on behalf of their customer, since you obviously did not.

This type of behavior is unwelcomed and will not be tolerated.

I too had the same problem. When I first contacted mBlox they told me the charges were from dadamobile, but they also said that no messages ever got through to my phone - that were returned by Cingular as rejected! Over a year ago, I completely disabled SMS/Internet access on my cell phone, because I use it exclusively for a 'phone' (interesting concept). If I never got any of your opt-in/out messages, how could I respond? You will not return calls or emails - All I get is a stock auto return email with the subject "Risposta Automatica". Your practices stink - you guys need to be put out of business. GO STEELERS!

you mentioned we could contact dadamobile through a toll free number. what is the number? because, there is no reference of a toll free number on your website. please send me the toll free number. i have requested a refund numerous times and i keep getting the runarounds. i didn't order the service or never used it and i have been billed twice! i would like to talk to a live person. please advise.

I have tried canceling this "service" of DaDa for atleast six months. I found this website after I paid a visit to the BBB website to file a complaint. I did notice that several people on this forum requested a toll free number and you still have failed to provide this??? I want this nubmer.....Your company had charged my cingular bill atleast $72.48 over the last six months...I am in the process of getting the prior six months worth of statments from cingular to see if there are any other charges out there. First, I read your reply on how people are registered with this service and I don't think you really know how secure this procedure really is. I NEVER agreed to have/use your service. I don't mess with such juvenile things like ringtones, games, wallpaper, etc... I have never used these "tokens" that you talk about either. You are more that welcome to research that and see that I have never used your service. I want this problem resolved and EVERY penny that you are taken from me back. I am a professional in the mobile technology and marketing industry and am quite familiar with the MMA guidelines. Yet even I have had trouble understanding how you choose to communicate and support the terms of your service.

I chose to enter my mobile number and proceed with password verification on my phone after doing a search for the mosquito ringtone. I have a brand new Sony Ericsson, but was unable to access the link you sent for my FREE download. The link was invalid.

I immediately sent a message to your email support address, but received a bounce back that the email address was invalid, so of course I never received a response from your support team. I did not realize there was a support phone number until today, which I searched for 10 minutes and found buried in your T&C's (this is a VERY bad customer experience).

The same day I registered, I received several text messages that appeared to have nothing to do with your service (and also did not have opt-out messaging at the footer). After the 3rd msg, I responded to your short code with STOP, and was relieved of further text messages.

HOWEVER, despite the fact that I opted out of your service the day I registered and was within the week of free service you advertised, I was still billed via Cingular. Thankfully I called Cingular and explained the situation. They cancelled my subscription with you, and credited me the $9.99 (which I assume, and hope, means you will not be paid for my account). If I was still subscribed after having opted out, you are not managing your db properly.

I cannot tell you what a poor user experience you are creating. I work for a company that is trying to use mobile marketing as a respectful means of communicating with consumers about information they want to receive. Having read some of the responses in this forum and the brooding distaste for mobile marketing, I can see companies like yours are going to make it very difficult for the masses to accept SMS as a viable customer communication vehicle.

Shame on you for your irresponsibility.

My boyfriend was subscribed to DADA without his knowledge or permission. He is a cop and is meticulous with his subscriptions and bills. He never received a text message telling him he could "opt-out". Even if he had, seeing how the text is worded, I don't know if he would even know what it meant. It is so cryptic, that I know I wouldn't understand it. When he started getting the text messages, we immediately sent several replies, stating "STOP, DESIST, CANCEL, END, REFUSE", any word we could think of that would end this harrassment. With each message, we got a reply stating that our message was not understood, and to please try again. You obviously will say anything to defend your sleazy company, including lie. I hope you can sleep at night, knowing that you work for a dishonest company. Do you really think that all these people who are complaining are lying? Why would we waste our time unless we are really disgusted with such a disreputable company?
