Support the Community Broadband Act

As long as we're on the subject of the digital divide anyway, it's a good time to point out a very important step we can all take right now to help eliminate it. We can let our elected representatives know we support the Community Broadband Act of 2005 and that we deplore federal and state legislative attempts to preserve broadband monopolies.


Do communities have the right to provide all their neighborhoods with affordable high-speed Internet access? As more and more communities have realized that wireless technologies make it possible for them to help the broadband have-nots, the "last mile" cable and phone giants have fought back by flexing their political muscle. The most notorious example is the lobbying efforts by Verizon over Philadelphia's citywide WiFi project, which resulted in a law that prevents other Pennsylvania cities from offering community Internet services of their own. But similar legislation has been introduced in many other states and some restrictions on municipal broadband enacted.

A bill that comes very close to an outright ban on communities offering Internet services to their residents has been introduced in Congress. H.R. 2726, the "Preserving Innovation in Telecom Act of 2005," was introduced in the House by Representative Pete Sessions (R-TX), who just so happens to be a former employee of SBC. If enacted, the bill would prohibit any state or local government from providing any telecommunications service "in any geographic area within its jurisdiction" in which a corporation is offering a substantially similar service.

In the Senate, however, a very different bill has been introduced by Senators John McCain (R-AZ) and Frank Lautenberg (D-NJ). S. 1294, the "Community Broadband Act of 2005," is designed to "preserve and protect the ability of local governments to provide broadband capability and services." It would preempt state laws that prohibit local governments from offering advanced telecommunications capabilities while requiring that such a "public provider" must follow all the same rules and regulations that apply to private entities in that jurisdiction.

Both of these bills were introduced before Hurricane Katrina came along and demonstrated not only how big the divide between the haves and have-nots really is but also how important wireless networks are going to be for the future of any community. So perhaps we can hope that Congress is going to recognize on its own which of these approaches is necessary now. But it would be best not to count on that. At Consumers Union's Hear Us Now site you can find out how to tell Congress you support S. 1294 and how to tell your state legislators not to enact restrictions on municipal broadband services. Or the Community Internet page for Free Press has instructions on how to call your Senators in support of S. 1294 and write your congressmen to oppose H.R. 2726. Take a moment to help preserve your community's right to decide its own digital future.

The Electronic Frontier Foundation on April 28, 2005 reported that Senator Rick Santorum (R-PA) introduced a bill (S.786) that would restrict the weather service from competing with private enterprise (Accuweather).

The irony in this whole thing is that while paying lip service to the aim of free enterprise and competition, the telecommunications bill and the weather service bill actually restrict competition.

In a true capitalistic system companies succeed by being able to sell a product that a consumer wants (with competition from other producers).  If company can not sell, then they go out of business. Instead we are evolving into an economic system that legislatively eliminates competion by locking out competitors and restricting consumer free choice.

The keyword in that rant is COMPANIES. Companies compete with other COMPANIES, not with government entities which pay no tax, need no profit, and are free to tax whomever they please to provide whichever service(s) they choose at whatever cost they decide to place on it. A truly capitalistic system by definition cannot include a government entity or it is no longer capitalistic.

In the case of Accuweather they're not the experts. The US Government through the National Weather Service produces the data they sell. It's because of the National Weather Service we can predict when tornados, hurricanes, storms and sunny days are coming. As a taxpayer for this critical infrastructure I should have access to this data. There's nothing wrong with a company like Accuweather providing value-add to government data just like there's nothing wrong with Lexis/Nexus providing value-add services and packaging to government records. The problem comes when they try to get a privileged position for disseminating that data. They should have no easier or more exclusive to that data than any flesh-and-blood citizen.

...that when money is doing the talking, words can mean whatever the "big boys" want them to mean. Orwell's doublespeak was not just a socialist phenomenon - it's obviously alive and well in our present-day capitalist society.

My favorite (?!) linguistic perversion of a recent vintage was when they removed the requirement that big telcos (ILECs) share their lines wih small, alternative DSL providers (CLECs) because this somehow impededed the big telcos ability to "compete" with big cable companies.

Can you imagine that kind of "competition" applied to any other field of endeavor? "The Olympic Committee announced today that only countries who won gold, silver or bronze medals in the 2004 Olympic Games will be allowed to compete in future games, as allowing other countries to enter might endanger the medal-holders' ability to compete with each other..."

First of all, if the IOC wants to make such a stupid rule, they're perfectly free to. They're a private organization, not a national government.

But more to the point, why on earth do we want to encourage local and state governments to spend more money on yet another set of services when they can't even maintain the services they already provide!? Why does anyone think it's a good idea for any government to own the means of communication?

Just because you'd like (or in this case, because you think someone else would like!) a product or service does not in any way make the market or the government obliged to provide it. Even if you think the reason the market isn't providing it is dumb or evil or misguided.

I agree completely. And while we are at it, we should close all the libraries. After all we have book stores in most cities and towns, so why should knowledge be provided at the public's expense? Likewise we should eliminate buses and other public transportation (they can always take taxis or hire a limosine), schools (there are many commercial alternatives), public water (you can buy it bottled) and many other services that are provided at public expense.

This bill would not require local governments to provide broadband access, it would just ensure their right to do so if that's what the community wants. This issue isn't whether towns should provide broadband access, the issue is whether towns should have the right to provide it.

How does that kind of reply foster an _intelligent_ discussion? The guy is entitled to his opinion and calling him names does not make your _opinion_ any more valid, but it certainly does reduce your credibility.

While some can argue that broadband is a luxury, there are many that disagree. (I suspect many that think broadband is a luxury are those who have it, but that is just my opinion.) To be equal, everyone needs equal access. Too many things are virtually inaccessible with no or slow Internet connections. Can people live without broadband? Sure. They can also live without good jobs too, but obviously not as well and that is the point.

Not directly related to your post, but there's a difference between allowing municipalities to provide services that they feel would benefit their constituents and requiring them to provide the service (as other posters have phrased it). The theory (which sadly does not always work) is if government officials are being wasteful, voters can vote them out of office.

Broadband IS a luxury! The only thing your really NEED BB for is if you are downloading a lot. Like say...oh...piracy? Secondly, what is the incentive for people to better themselves if teh government just hands them everything? And why should the people who do work their asses off to have luxuries continue to do so if the everyone else is just handed everything? Secondly, what is a good job? WHat is a bad job? SHould burger flippers that dropped out of high school make as much money as someone who actually studied and worked hard for a better careeer? That seems to be what you are saying... What exactly is too inaccessible without broadband? You can still look up information. You may not be able to D/L music and videos, or watch streaming video, but then again those aren't neccessary, those are luxuries... I don't where this ideal that everyone is and should be equal comes from, but it has NO basis in reality....
