Reader Voices: Unjustifying Piracy

I've always been rather dismayed by one response that our chronicles of various abuses on the part of software publishers will occasionally elicit. Someone will post a comment that the software company's objectionable practices provide justification for pirating their products. But one such comment recently prompted a reader to make a very persuasive argument as to why such thinking is totally off base.


"If you steal software from a company who uses deceptive marketing practices, then you are still indirectly supporting that company by not supporting its competition -- whether open source or closed source, whether free-as-in-beer or commercial," the reader wrote. "This is especially true if you are stealing from a company who has market dominance. Ultimately, that hurts you. If you steal software from a company who does not use deceptive marketing, then you are not only hurting a reputable dealer, but you are again hurting yourself by making it more difficult for a reputable company to make a profit."

Yes, deceptive marketing practices are wrong, the reader said. "No company should be allowed to get away with it, nor excused for doing so," the reader wrote. "However, I don't understand why people can justify stealing software as if two wrongs make a right. When you don't pay for software, you are really just trying to avoid inconvenience rather than do the right thing. Imagine the positive effect if we could teach people not to purchase from spam. If even a very small number of people purchase from spam, then it is profitable. Copyright violation has the same counter-productive effect, if not as directly so and not as obvious. I get the impression that a lot of people simply feel entitled to be able to do a certain thing on a computer and don't want to be inconvenienced into doing something themselves or using a less-finished product. Grow up."

If everyone voted with their wallets against the kind of practices we don't want software publishers to use, they would have to change their behavior. "If we support an honest vendor whose product is not as good, we help that vendor improve their product -- by giving them revenue -- and we send a very direct message to the dishonest vendor. When you steal, you only send the message that you want to use something without paying for it. That is the full extent of what you are telling the company whose product you are not using legally. One choice motivates companies to avoid practices that annoy the market; the other choice motivates companies to implement stupid, restrictive, and mostly counter-productive, let's-punish-the-honest-consumer DRM. This is why I get angry when people steal software. They are not only hurting themselves, they are hurting the rest of us."

There is no excuse for outright piracy. (Confusion/ignorance is entirely different; most vendors have licensing models that are so confusing that companies have to buy licensing servers and software just to keep some track.) It's illegal, immoral, and selfish.

It's stupid, too. You're risking not only your job and career, but a costly lawsuit or even criminal prosecution, all for that $200 you were too cheap to shell out but wanted in a hurry.

I'm not sure how I feel about cracking purchased software to do away with little evils. The consequences can be just as severe, but morally and ethically, if you're complying with the law and only using it to strip out activation, DRM, and copy-protection that breaks, without going on to give it to others... I can see that being justified. I just wish it wasn't a problem in the first place, so the hard choices could be avoided.

(Ex: We have a mortgage form software that requires online activation, however, it's pretty wretched and either has to be uninstalled or needs a whole system wipe (yeah, it's pitiful) every few months, so we go through activations like candy, and even when we have more it usually doesn't work the first few tries. I keep begging them to give us an activationless version, because every call we get grilled, upsold, and treated like theives. I'd crack it myself, except there's always new updates out that never seem to be much more stable. They've simply stopped returning my emails lately.)

(Collary: The smaller the company and niche, the less choice you have, the more wretched the copy protection, and the less support you'll get.)

I intensely dislike software that requires "activation". In one case, it took weeks of emails before the company gave me an activation code that worked (and was totally different from the inoperable one their website gave me). I used Windows 2000 long after Windows XP came out - in fact, I waited until hacks were available. At which point I purchased a legal copy, and proceeded to install the hack -- my XP doesn't activate. This applies to any software that wants to activate. I will either abstain from using it (continuing to use the old pre-activation version), or use it only if a hack is available. Software activation schemes are not only a royal pain in the backside, they are dangerous. What if you develop a dependency to a specific version of some package and the company decides to discontinue support? The next time your computer breaks, you're toast. You're forced to purchase the current version, which may not do what you need (useful features are always being deleted from software). You're up the creek without a paddle, as the old version won't work and the new version doesn't meet your needs. I see activation schemes put forward as a cure for piracy (which it isn't, hacks are always available), but in reality it's a scheme for the company to force upgrades at its own convenience.

Unfortunately, buying software but then installing the cracked version doesn't really help. While you might think it helps you in your situation, what you're really doing is telling the software vendor that activation is OK. Because you bought and paid for the software, you must approve of the feature set, including the activation scheme. So while you've solved your momentary problem, you're contributing to the overall problem of vendors using activation.

What we all need to do is tell the software vendors that we won't buy their products until the activation scheme is removed. Only by doing this, and not buying software that requires activation, will the vendor reconsider and maybe remove the activation scheme.

There are a number of vendors of various products, not all technology-related, that I refuse to buy because of the actions of the corporate parents or the way they've treated me. I vote with my wallet. But my vote won't count for much unless you and lots of other people also start voting with your wallet by only supporting the vendors whose policies you agree with.

I agree with all of the above, but I suspect that Microsoft is immunized to activation complaints in a way that say Intuit wasn't... I wish I had numbers to prove most of these points, but I suspect most folks don't buy Windows through retail (either as upgrades or as full products for installation on computers), but rather just get Windows through the purchase of a new computer. Those computers generally don't have you go through the activation issue. Thus there is very little opportunity to experience activation, pro or con, in Windows. This us unlike the case with Norton AV or Intuit's Tax software, where you're likely to come into contact with activation annually.

That's fine for most software, as I can use older copies and survive. However, it gets hard to find old Windows drivers for some of the newer hardware. Replacing Windows with Linux is a major undertaking, and just trying to find replacements for the dozens of Windows software packages that I use on a daily basis would be intimidating. Granted that most Linux applications are free, or reduced cost, trying to learn to use the replacement software would be a major undertaking in itself. As I see it, the only way to "vote with my wallet" and still survive would be to use pirate copies. And, however much I hate activation schemes and the idiotic companies that use them, I draw the line at that.

I agree absolutely that moving from any one OS to any other OS is a major undertaking, and it can be and is intimidating to many people. I agree with all of that, but I disagree with your conclusion:

Yes, it can be a huge inconvenience to switch from one operating system to another. You do understand, I imagine, that the companies bank on exactly that. That is the secret to all lock in, not just in the digital world. The digital world is not really innovating in this regard, it is just taking lessons learned from physical objects and applying them more thoroughly, because in the digital world there are whole new ways of raising barriers to changing that don't exist with physical objects.

So, yes, absolutely, software companies make it as large an inconvience as possible to switch away from their wares, and by doing so they bank (pun intended) on the fact that few consumers are willing to face that inconvenience. That is the exact reason why these oppressive software companies survive and why they retain market dominance.

When one does not take even the little steps to stop using products whose companies are using offensive tactics, one only ensures that those tactics will continue and will in fact continue to get worse until the market place requires the companies to reform. In my mind, you (generic you, not the person I am responding to) lose much of your right to complain about a problem when all of your actions serve only to make the problem worse and when you are unwilling to take even the smallest steps toward doing something positive, something that will actually change the market for the better.
