Spam for TaxAct

By Ed Foster, Section The Gripelog

On the frequent occasions when TurboTax comes under fire here, TaxAct from 2nd Story Software is one of the tax programs readers often recommend as an alternative. So it's rather disappointing to hear a few readers sound a very different note about TaxAct -- namely, that 2nd Story seems to be using spammers to promote it.

"I see in the comments of your GripeLog site that others have also received spam from third-party spamming companies advertising TaxAct," a reader e-mailed me recently, copying me on such a message he had just received. "It appears to be directly sponsored by TaxAct, but the company that sent it promotes a number of other spammy sites like mortgage deals and magazine subscriptions."

The reader traced how the link in the spam he received was re-directed through a series of URLs to arrive at the TaxAct sign-up page. In the process, it appeared to have been tagged as coming via a "TaxAct Affiliate" partner, which means the spammer would get 50 cents if the visitor downloads TaxAct and 15 percent of any orders.

The reader is certain he had nothing to prompt the spam. "I never ever sign up to receive marketing info from anybody," he wrote. "And I don't even use tax software, so I certainly haven't done any signing up with TaxAct at all. My e-mail address does receive a lot of spam, mostly of the scam variety; it's on a large number of spammers' illicit e-mail lists."

Since he's not the only one with an e-mail address that's on a lot of spam lists, it was easy enough for me to duplicate his experience. Checking my own filtered e-mail, I found several similar spams in the last few weeks advertising TaxAct, each from a different spam house than the ones readers had identified. And each also wound up at the TaxAct sign-up page after apparently crediting the spammer as the TaxAct Affiliate who delivered the hit.

So spamming for TaxAct seems to be a game a lot of sleazebags are playing. Of course, affiliate programs are vulnerable to being abused by spammers, but you have to suspect that 2nd Story could do a much better job of screening its marketing partners. And it certainly could provide a better mechanism for taking complaints about affiliates who spam. If 2nd Story doesn't want to be known by the company it keeps, it had better get its act together.

They've been spamming over a year now[ Reply to This ] (none / 0) (#1)

I received spam from them last year and reported it to them and their reply is that they are not responsible for actions by affiliates. I pointed out that if you pay someone to commit a crime (which this is probably not) you are also guilty and they then replied that they would continue to pay affiliates to drive business to them even when the affiliate uses spam. I pointed out that ethical companies have clauses in their affiliate agreements that deny commisions to spammers and that this cuts spoam for these products to almost zero. They declined to do that.

I used taxact this year because it was free. It did exactly what it was supposed to do and did it fairly well. I use a firewall on my computer that warns me if unauthorized programs (i.e. spyware) try to send out data over the internet - Taxact did not attempt to access the internet. TaxAct also did not include any third party ads although they did included a few non-intrusive ads for their fee-based upgrade. I have not received any spam from them that I know of (my spam filter works pretty well). I used google to find them. Bottom line, the only thing I have to say to TaxAct is "Thanks". Taxact is truly a free program, and very mindful of the user in it's implementation. The reason I have taken the time to write this up is that it seems ironic to bash Taxact when it's competitor, Intuit's TurboTax, is the king of all trashy, invasive adware. If you are going to bash, bash Turbotax. They have the nerve to put shortcuts on your computer that link ti anyone who pays them. My screen space is not for sale and I will never buy an another Intuit product.

Spammer Affiliates[ Reply to This ] (none / 0) (#2)

Of the hundreds of spams I get a day, many of them are from spammers trying to make their money throught the affiliate programs of legitimate companies. I see this with so many affiliate programs that I don't see any need to single out TaxAct.

Dear Ed, GripeLog readers, and partcipating blog members, Because we at 2nd Story Software, Inc., makers of TaxACT, are interested in providing for the needs of our customers, as well as having a firm understanding as to the overall perception of our company and our product's brand, I feel it's imperative to reach out and address the concern that you have expressed within your Web Log as it relates to the appearance "...that 2nd Story seems to be using spammers to promote (TaxACT)." Please know that 2nd Story does not condone the use of Spam; nor, will intentionally employ the use of an advertiser or publisher (directly, indirectly, or otherwise) to utilize spamming techniques on our behalf to promote TaxACT products. The reason is simple: credible branding of a financial product such as ours is everything - the act of `spamming' does much to hurt a reputable brand such as we have taken great care and numerous years to create. This is precisely why we have a "ZERO Tolerance Policy" written into each of our agreements as it applies to advertisers, their affiliates, as well as publishers that register directly with 2nd Story. More to the point, because we do take the privacy and related rights of consumers to heart, we take every precaution possible to prevent unsolicited e-mail from being sent. Unfortunately, though we diligently screen advertising companies, affiliate networks, and individual publishers, a few bad apples have flown under our radar and have taken it upon themselves to indulge in wrongful behavior. When this happens, we at 2nd Story do not hesitate to prevent this independent agent from continuing to profit from this activity. If fact, whether it is an advertiser that we have contracted, an advertiser's affiliate, or a publisher that has registered to promote TaxACT directly with our company, we enforce the wording of our advertiser and affiliate contracts to the letter. And, I would be remiss if I did not point out that enforcement is not limited to revoking one's marketing privileges - it also includes withholding any commissions the independent agent would have otherwise been entitled to receive in the absents of this practice, which put them in breach of contract. Thus, the point cannot be stressed strongly enough: if you or any consumer believes that they have received an unsolicited promotion bearing reference to TaxACT, not only do we want to be alerted; 2nd Story will behave in a workman-like matter to resolve the issue. Consequently, I greatly welcome receiving any information that you can supply so that we can track down the party responsible for sending the promotion. To do this, we simply would need for you to forward the entire e-mail that you received to marketing@taxact.com. This e-mail will contain a tracking code that will, ultimately, pinpoint the party that was responsible for sending the offer - giving us an opportunity to resolve this matter. Sincerely, Stephanie Behrends Communications Manager 2nd Story Software, Inc. 5925 Dry Creek Lane NE Cedar Rapids, IA 52402 Ph.
