Sneakwrap and DRM

If we ignore the nasty EULAs, will they just go away? After last week's heaping handful of bad terms, more than one reader expressed that sentiment.


"I have been reading you since forever, but I think I'm going to have to stop --- I get way too upset," wrote one reader. "Don't get me wrong, you have great material, but your latest issue has put me over the edge. I think that most EULAs are indefensible. I can't consult an attorney to make sure what I'm agreeing to for a $200 program! I also can't take the time to read every EULA to make sure that I need to! So here is my plan. I'm just going to use the software or hardware that I buy assuming that the company I purchased it from is being reasonable and just. If they really are not reasonable and just and want to prosecute their remedies, then let them. If that action causes me enough pain then I will make it my life's mission to make sure they pay. I will let the whole world know about their actions. I will not be silenced. I will then make it my life's mission to reform the whole concept of EULAs so no one else will have to put up with this kind of stuff."

Boy, I must admit that the reader's plan sounds awfully tempting. After all, he's quite right that real people in the real world don't have the time to read all the terms they are supposedly agreeing to on a daily basis. And, of course, most of the really awful terms would never fly in court. If Hilton wants to force people to hire a lawyer to visit their website, or Autodesk wants to repossess all copies of AutoCad owned by companies that are in financial straits, then let them explain it to a judge.

Unfortunately, though, there's something else we have to take into account here: DRM. Whether you think the acronym stands for Digital Rights or Digital Restrictions Management, it's an everyday part of life now. What hoops will you need to jump through to reload your software applications if you have to replace your hard drive? Can you cut that tune you paid 99 cents for to another CD without the RIAA storm troopers breaking down your door? And, given the leaning of industry and government, it's likely to be all the more commonplace. Will the broadcast flag on the TV show you're watching permit you to fast-forward through the commercials? Or will the RFID chip in your car keys lock you out if you miss a monthly payment?

So what's the connection between DRM and sneakwrap terms? The common thread is that with both, customers don't really know what they're buying when they put their money down, or at least not without reading through multiple layers of fine print. And they might as well not bother to do that, because the deal can be changed retroactively by the seller as you go along. Hey, you have been granted certain rights, up until the time we decide to take them away from you, at which point you have no rights.

For the vendors, of course, DRM also means never having to go before to judge to argue that their unconscionable EULA terms should be enforced, because the DRM is judge, jury and courtroom, all rolled into one. I don't think it's just a coincidence that the terms readers found most objectionable in last week's poll were from an adware company that is suing another adware company over its software being automatically removed by the competitor's software. The case is really one of EULA vs. EULA, with both companies claiming virtual ownership of your computer because you supposedly agreed to terms allowing them to do so. And, as spyware expert Ben Edelman reported from his research, it's quite possible for both programs to load through security holes without users having the chance to know it's happening, much less "click OK" to the terms signing over control of their computer.

So, yes, I like our reader's plan. But he and the rest of us all have to understand that is already time for his Plan B. The whole concept of the EULA has to change, or we are faced with a world where our computers, our privacy, and our lives can be controlled by whichever outfit was the last one that slipped some sneakwrap terms past us. Next, we'll discuss one small step we can take to try to do just that.

Broadcast flags and bypassing commercials[ Reply to This ] (none / 0) (#1)

If we are forced to not bypass commercials on a TV show that we record, does that mean that we might not be able to rewind to see something more than once? After all, the show was only broadcast only once, so should we only be able to view it once? And if we rewind, do we have to view additional commercials (after all, we are given the privilege of seeing something more than once - we have to pay for that with additional commercials). But then again, by viewing a show a second time and having to view the commercials again, we've changed the ratings on the original show, so shouldn't the advertisers pay the broadcaster higher rates for the ads?

Actually, considering the VAST number of commercials, why are the Cable and Satellite companies allowed to charge us anything at all?

Huh? "Allowed"??? The implication being that someone (goverment?) would prevent broadcasters from using commercials?

On what basis? A quick check of the Constitution reveals no grounds for this.

Hey, it's just free enterprise. Hit the off button if it displeases you. Or, cancel your cable. Get some fresh air.

Just torrent it. 90% of people who torrent cable/network TV I know do it just to get rid of commercials or because it's at an inconvenient time. Tivo, round 2.

(I can just imagine what'll happen if a Tivo clone ever gets released that auto-torrents your recordings for the rest of the world. Even if it's only for 'free' network TV.)

...because cable companies are paid to get the content to you, not make the content. While I hate my local cable company (Which is also my phone company) as much as the next guy, they make no money from the ads on USA. In fact, they have to pay to show a few channels. (Not most of them, but some.)

Saying 'they should give everything out for free' makes no sense...they would have no income at all. They couldn't afford to run the wires.

If you want to skip the cable company, it's perfectly possible for you to get all the 'free' channels, the one the cable companies do not pay for, for free yourself, with big satelite dishes. Of course, you'll still have commercials in them, because those are added by the channels themselves, and you'd have to operate like twenty dishes to get all the channels you wanted. (And, obviously, you can get all broadcast channels with rabbit ears.)

Of you could pay the cable company a fee each month and have them run wires to your house and do that for you.

Yes, the practice of forcing purchasers of DVD's to watch ads/previews/logos is extremely annoying; Paramount DVD's are especially bad in that you have to wait for the opening logo to come up before you can choose main menu or movie. (At least you get a choice) Fox DVD's show a bunch of warnings on a red bacground, but at least you can quickly chapter-skip through them. Fortunately, tools like Anydvd or dvddecrypter can remove those restrctions.  

It's the next generation of HD-DVD/Blu-Ray that I'm concerned with. It will be awhile before the copy protection technologies are broken on those. (At least, I hope it will be awhile. It's better for consumers if it's cracked after there's a huge installed base of players.) So, there's going to be all kinds of forced ads/logos/previews on them.  
Hopefully, consumers will revolt against the practice and refuse to buy them, but I'm not holding my breath on that happening!

Will the movie theaters lock their doors at the start of the commercials and "force" us to watch 20 minutes of ads before the movie starts? Will the magazine advertisers "force" us to read all their print ads in order to read the articles? Consumers willingly pay for one thing, but are "forced" to take (view) other content as well - even content that may be offending to them. Where does this end?

When to view a dvd, Web page, etc. you must first view an ad, and then correctly answer a brief, computer-administered "reading comprehension" test that proves you viewed the ad, of course, instead of leaving the room, skipping it somehow, or having your browser block it. A test the browser writers will need to solve the NLP to bypass in an automated way. :P

This part of your comment "Will the broadcast flag on the TV show you're watching permit you to fast-forward through the commercials?" reminded me of a real irritation that already occurs:

Have you noticed you cannot fast forward past the studio ads and FBI warning at the beginning of DVDs when you are watching them?

Do the studios really have the right to force me to watch their logos? I know this is a little thing, but I hate that!

May I recommend this program? It bypasses things like no fast forward through ads. It in theory bypasses no chapter skip but that doesn't always work. (And the manual warns about this--it can remove the restrictions, it can't ensure the result will always do what you want.) Obviously you have to be playing the DVD on a computer to use it. However, you don't need to reburn it like with DVD-shrink.

I agree that it's annoying.  I'm actually in the habit of putting the DVD in and pressing play before I turn on the TV.  I'm usually ready to watch by the time it's through with the mandatory viewing.  Every once in a while I turn on the TV to find myself 10 minutes into the movie and am shocked.

I can't figure out why the designers of DVDs have menus where you have to watch some little animation before you get your selection.  Imagine running some computer software that did this, giving a 5-second response time after you selected something (I'm sure there are some out there, but nothing I use does this).

You can if you rip the dvd and defeat the prohibited actions, a simple thing to do with free software. And it will certainly become necessary to do this. The latest big dvd, GRUDGE had about 15 movie previews and ads included. Soon we can expect conventional advertisements for cars, refreshments etc on our dvds, doubtless justified by the providers as ofsetting the billions of bucks they claim to lose to evil pirates.

I would think this sort of thing would just encourage more "piracy". You've already paid for the stupid thing, why should someone else have their fingers in there forcing you to watch 20 minutes of commercials before you can see the movie? That's double dipping. If they want to put 20 minutes of commercials on there and force you to watch them, then the DVD should be free.

We use the time for their previews and junk to get our snacks and other stuff together. Dislike it royally. I feel hijacked all the time. There is no way they can force me to watch or listen to their junk when I am wanting to watch a movie. :)

Personally I don't mind preview when they have an extra menu to watch them. I actually do watch them AFTER the move. I do believe the forced previews before the menus promote piracy, which last time I checked, they weren't pleased about. I was a regular dvd buyer back when they were, you know, worth buying without the forced previews. Now I only buy a dvd here and there and if there are any forced preview I remove them with free tools and reburn it for myself. I then, to get back at them in a small way, burn multiple copies of the preview-free movie and give them away to whoever wants one. They have really pissed me off with this. If only they kept them in the special features menu...

In 2000, the Virginia legislature passed a law that made click-wrap licenses binding. As I understand it, if I "agree" to an unfair license agreement and am taken to court by the other party (or vice-versa), the terms of the contract are binding even though I never even read it, and the judge is going to throw me out on my butt. This was done amid all sorts of hoopla about bringing Virginia to the forefront of the digital age, with very little discussion, and the result is that Virginians, at least, got the shaft.

The comment about not doing anything until it directly influences me reminds me of the historical statement about "...if I don't stand up now against persecution of other peoples while I have a chance, who will be left to stand up for me when it's my turn to be persecuted...". Unfortunately, just hiding ones head in the sand until you get kicked in the butt just lets the kicker establish a "norm of behavior" that becomes common-place, if not acceptable, since everyone else would be letting these practices continue also.

There has been a judgement against someone who wrote a program installable on DVD players to avoid this unwanted advertising. The program violate the Digital millenium act to protect the rights of the poor little companies like Disney, Universal, Paramount...

My 5 year old son was looking at such advertising a few days ago and I was wondering why they have the RIGHT to do whatever advertising they want to my son. I can't figure why they have so much rights and my son so few... I paid for the film and they made a profit on it. Isn't that enough? Do they really need to force feed my son's mind with what they want?

According to the law, my son should be forced to listen to this if he want to see the film. Curiously, another law clearly states that advertising to children is forbiden here in Canada.

As in EULA and DRM and most of these litigious issues, the trouble is in the abuse on either sides. Some customers abuse as much as they can. Many companies abuse as much as they can.

Since you can't afford to take the change that DRM will void your software, some company will offer to repurchase the software for you in exchange for an annual premium of 10% of the purchase price! Or insure your entire office suite in bulk for only 5%!

Since they started putting commercials on DVDs, I no longer buy them. I rent the DVD, RIP it and burn just the movie. No commercials, no "Special Features", no intro crap, I just get the movie. And since blank DVDs can be found for ~30 cents the whole thing cost me about $1.30. Screw the morons. The more they tighten their grip the more that slip through their fingers.

FLAME ON..... You all expect the companies that make and distribute DVD's and entertainment media to WILLINGLY give up the chance to squeeze more money out of 'their products'? What fools you be if you expect ANY company or the government to give up the chance to make money! NO WAY! It's the AMERICAN way to f--- your customer out of however much you can gouge them for, while simultaneously giving them as LITTLE as possible for those dollars. Try to be nice to a customer some time and give the pr--- a break on the price, and each and every time they walk back through your door, they want the same deal every time. On EVERYTHING. What happens? You lose your shirt and go out of business. If you aren't nice to the customer, they still f--- you by copying your stuff then returning the original if they can, or use some other subterfuge to recoup their percieved 'loss'. So who is right and who is wrong? Everybody wants a deal, but nobody wants to pay for that deal. They want everything for free, while the companies want to make money off their product so they can pay their investors. What can you do, you ask? F--- them all and ditch your computers and TV's and MP3 players, turn off the cable and the radio, except for weather and news, and read a good book. Buy a lot less, pay a lot less. Don't go out and buy a new DVD every time you turn around. Wait for a few weeks until everyone ELSE has bought one, and the flippin' price comes down. If you are that hell bent on 'staying current' that you MUST have the latest movie out on DVD, then you are truly f---ed because you will ALWAYS be shelling out. You all seem to forget that YOU have power in the form of what you buy and what you spend your money on. THEY will have NO power over you if you don't BUY THEIR PRODUCTS, or USE THEIR FACILITIES, or SPEND AT THEIR STORES. Of course, everyone will just breeze through this (If they read it at all.), and say "What an A--HOLE that guy is. NOT spend money? NO F---NG WAY! What I BUY DEFINES ME." Consumerism. They have trained you to always want more and more. No wonder you don't have a dime at the end of the month. Show a little self control and make do with a little less. It really doesn't hurt, and when you see your bank account has money left in it at the end of the month, you might begin to SAVE money, instead of spending it on a DVD you might watch three or four times before it gets put in the pile of 'old movies', and you're out spending another thirty bucks for all those commercials and teasers. .............. FLAME OFF

Everything goes up because fools like you keep saying "There's always more where that came from" Nothing is forever, contrary to popular belief. When gas is $75.00 US a gallon, and cars are permanently parked and being used as living spaces in the cities, don't start whining about it. You have a choice, and obviously you made yours. It seems everything you buy now'days no matter whether computer related or not, has some stupid thing the vendor wants you to agree with -- even extension power cords where the last foot of cable is covered in warning labels. My thinking is screw'em! If I want or need a piece of software and I actually take the time to buy it as opposed to downloading it, screw-em. Once they have my money I'll do with it what I want. I'm not talking about sharing it, but if I'm the only user and I have 3 PC's, it's going on all 3 PC's. If I want to hack it or modify it, it's getting done. If I want to benchmark it, do screenshots, anything I want to do will be done. The company has my money, so screw them. EULA's are there to cover the company's ass if worst case happened. As for software that requires activation, I avoid that crap if possible. If I can't install software on a standalone PC, it's going back to the store.... and luckily I haven't ran into this. So my idea on EULA's, just ignore them!
