Case Against Zone Labs is 180 Degrees Off

In case you missed it, the best recommendation you're likely to see for an anti-spyware product just appeared for Zone Labs' ZoneAlarm Anti-Spyware. And the source of this highly favorable review is from people who know a lot about programs that are up to no good: 180Solutions.


Last week the news broke news broke that 180Solutions has filed a lawsuit against Zone Labs over its anti-spyware product. The suit alleges that when ZoneAlarm -- the anti-spyware product, not the firewall -- tags such 180 applications as 180Search Assistant and Zango as exhibiting "dangerous behavior" and recommends their removal, this constitutes "false and misleading statements about 180's products (causing) thousands of 180's customers to remove or otherwise uninstall Zango and/or (180Search)." So 180 seeks an injunction and damages from Zone Labs for trade libel, tortious interference, unjust enrichment, and unfair and deceptive trade practices.

Now, this is going to strike anyone who knows anything about spyware as a little strange. After all, any anti-spyware product that fails to identify and offer to remove 180's applications would be absolutely worthless. While -- like fellow "adware" vendors Claria/Gator, WhenU, and Direct Revenue - 180Solutions has been trying to polish its public image and distance itself from its most nefarious distribution practices, the prevalence of 180Search and Zango is one of the main reasons that anti-spyware software is becoming a big business. So why pick on Zone Labs specifically, rather than the many other vendors who have also caused thousands of 180's victimized "customers" to uninstall these applications?

To judge from the complaint filed by their lawyers, it would appear 180's real problem with ZoneAlarm is that it doesn't phrase its warnings about 180's products as politely as some other anti-spyware products do. "ZoneAlarm identifies both Zango and 180Search Assistant as a potential 'threat to [the user's] security and/or privacy,' and it classifies both products as high risk," their lawsuit reads. "The 'high risk' classification is false and at odds with the industry norm and leading scanning applications, such as Symantec, which recognize that 180's products do not pose a privacy risk to users."

It's a sad fact that, as the big guys like Symantec and Microsoft have moved into the anti-spyware game, the trend is to be much more euphemistic about what you label as spyware, particularly when the spyware vendor claims to have gotten the user's consent to the installation through a EULA. While "potentially unwanted software" like 180's apps will still be tagged by the anti-spyware scan, the default setting now will often not be to remove it. Increasingly, anti-spyware vendors simply aren't calling a spade a spade, and that of course is a trend the adware crowd like 180Solutions wants to encourage.

So the real point of this lawsuit is not that ZoneAlarm is saying misleading things about 180, but that it's being too clear and accurate. The complaint focuses on the fact that the ZoneAlarm persists in warning its users that the suspect application's behavior means it could be monitoring them, "despite Zone Labs having been advised by 180 to the contrary." Along with not being willing to take 180's word for what it does with the information its programs could be collecting, Zone Labs also is accused, rightfully so, of assigning a high risk status to 180's apps and stating that it "is recommended that you delete this application immediately because it constitutes a privacy risk, and has no known usefulness."

Well, that sounds like a pretty accurate description of 180Search Assistant and Zango to me. Contrast it with the way 180 describes its business practices in the complaint: "Much like other innovative Internet content companies such as Google and Microsoft, 180 has helped develop an advertising-based business model that allows it to generate revenue from original content, while continuing to allow that content to be made freely available to users," it reads. And then this: "Similar to network television, 180 provides its users with unlimited free access to its entertainment content (game and software applications) in exchange for the user's agreement to view a limited number of advertisements per day from 180's sponsors."

Oh, please. Which company is it that's being misleading and deceptive? ZoneAlarm has every right to sound the alarm whenever it detects an application that's doing something that could be dangerous - that's why customers bought it. That its alerts result in removal of 180's programs is the proof that they aren't really the "consent-based applications" 180Solutions claims. If they were, after all, users would be unconcerned by even the most strident warnings of an anti-spyware scanner because they would presumably know what 180search Assistant or Zango is doing on their computers.

I don't know what will happen with this lawsuit or whether Zone Labs will feel compelled by it to tone down its descriptions of suspect applications. I hope not. But at least 180Solutions has done us all a favor by pointing out that there are really differences between anti-spyware products and giving us such a clear -- albeit 180 degree -- recommendation. Assuming we continue to have a choice between a ZoneAlarm that tells it like it is or a Symantec that soft peddles the risk suspect programs pose, I know which one I'll choose. How about you?

I'm not familiar with the Zone Alarm products, not being a user, but here's a possible response. It would seem that Zone Alarm would have an option that provided for something like - this is so low risk and so unwanted that you can delete it without telling me anything. If they don't, they need to add it and comply with 180solutions complaint about making them high profile, by putting thier software into this no notice given category.

As a person that works on PCs I find it amazing that anyone would support 180solutions or other spyware companies whose products place a tremendous burden on PCs causing them to underperform and be opened up to other malware programs. Wake up those of you that think 180solutions deserves any kind of a break. Would you support companies that put additives in your car's gas tank that dropped your mileage by 80%? I don't think so. That's the equivalent of what 180solutions is doing to PCs.

180search Assistant is scum ware. It has downloaded on peoples pc,s when they go to some sites. Everyone has been to sites that say you must install this software and you click off of it or choose no and it will pop right back up before you can X off the page.Ctrl Alt Delete and bring up Task Mananger to shut off inetenet explorer if you get this type of web site. Also i have worked at a pc shop and have seen many pc,s with the 180search on them and when you go to add remove programs to remove it its a pain in the butt. And all the pop ups you get with this scum ware is un real. We have a right to have our pc,s clean of scum ware like this and dialers and Trojans. I have seen programs like this slow a pc down to a crawl. Before i did not know about spyware/scumware i was hit by the 180search and did not know where it came from and a friend had me rin ad aware pro and clean it up but the bad thing about this is when u run a program like this over scum ware you are usually stuck with seeing it in add and remove programs forever. So I always go to add remove programs and remove it from there then run a spy ware cleaner afterwards. I think its sad when 180search people attack Zone Labs for warning people that this program is on there pc but maybe Zone Labs need to change the way the alerts are sent to us. Something like There is a possibility that this is spy ware and click here --- to read about the program, so it would be our choice to blow it out of our computers. I run Zone Alarm Pro and have for many years and trust it totally.

Did you read the artical? Do you understand written English? Zone Alarm is doing exactly what it was made for - looking for spyware and offering to remove it! 180Solutions doesn't like the label of "spyware", but that's what they are.

In Denver, there is a talk radio who called the Troubleshooter. He bills himself as a consumer advocate, and he very strongly advocates for the consumer. He's not shy about giving his opinion about the businesses that he has problems with. He hasn't been successfully sued (to my knowledge, anyway) because his show is couched as his "opinion", and opinions are protected under free speech. Could Zone Alarm put a similar disclaimer in their license agreement or warning message ("it is our opinion that the identified software is dangerous...") and be protected from annoyance litigation like this?

Change 'solutions' to 'weasels'[ Reply to This ] (none / 0) (#3)

Whereas Google and others' adverts do not require invading software in order to deliver their hits, 180 continues to change the behaviour of a user's (victim's) computer regardless of the site visited.  

All I can say is that the scumware removers must be doing something right (cutting into 180's revenues, perhaps?) to get the lawsuit machine running.  Most users are unaware of the 180 software stealing their resources and redirecting their intentions without their consent.  If there was a donation fund set up to defend those helping defend us from the likes of 180, Claria, etc., I'd be first in line to contribute.  

We pay for our internet connection and our computers - 180 does not.  Snail 'junk' mail is free content, too - but I have yet to hear of the credit card companies suing for someone calling their ad delivery mechanism less than what it is...

Yes, it might be good. Now that the spotlight is shining on 180, perhaps people will become more aware that there is such a nefarious spyware running. And with the lawsuit out, perhaps by news, or by word of mouth or by blogs, more people will know about it and drive that company to the sand.

I've been a Zone Labs customer almost from the first free download version, and I am largely responsible for my company using their corporate solution. I am 100% on their side on this issue, sight unseen. If somebody has the time and the energy to start a Friend of the Court statement and petition, I'll sign it twice! (Once for each personal paid license of course.) Let's get this thing dismissed before ZL has to spend their money in court rather than in software enhancements. Steve in Flyover, CA.

As a foreign resident I cannot get the Friends of Court statement started, but I can sure sign it. I too have been using free versions of ZoneAlarm, Spybots and similar products for some time. I also have installed paid-up versions at my place of work. Personally, I would like to get in on a class action suit against 180Degrees and any other mouth breathing idiot boy (or girl) who thinks they have the right to install any software on any of my PCs without my EXPLICIT permission. (and that includes so-called benign cookies!)

There was a piece in the Dec 2005 issue of "Wired" that is right on target. It states "Don't call it Spyware - first the company was considered a parasire and scourge. Now it's a rising star - selling virually the same product. How a pop-up parish won the adware wars." Ihe piece goes on to explain how "Gator" (now renamed "Claria") solved it's image problem by suing, or threatning every spyware removal software company that presented a problem by reporting their stuff as spyware/ adware. This includes "Symantec" and also mentions Microsoft. The big software companies that have a lot to do with how we view the "digital world" have sold out! Expect Zone Alarm to do the same. The new computer users will never know how it should be but rather just how it is - in a very short time.

I wonder if there's a solution along the lines of allowing the alleged spyware manufacturer to make a rebuttal available that spyware removers could automatically post a link to?  Clearly there are some issues, such as not using the link to install more spyware, but if these can be addressed such links would have three benefits:

1) A safety mechanism in case of false positives.

2) Any spyware that doesn't provide a rebuttal link can be deep-sixed without much thought.

3) It would be easier to get lawsuits against spyware removers dismissed.

As to what the spyware manufacturers would write in their rebuttals, I have no idea.  They should be good for at least a chuckle.

Here's a class-action I'd like to see happen. What if someone is not "permitted" to install an application on a computer per the owner, however that person is using the computer under an Administrator account (a sad state given many WinNT/2K/XP apps are so poorly programmed they require it...) Say this person is a child, a friend, an employee, etc.--why can't the owner of the PC sue the adware companies? Especially when we deal with situations where a child installs something... Here's another question--is it possible to install ActiveX controls & other adware without an Administrator account??? If so, they're blatantly finding ways to allow people who obviously don't have the owner's permission to install an application and surely don't have the owner's consent (or a representative of the owner's consent) to install the app.

C'mon people. Sony's getting sued for less than this!

I keep my users on non-administrative accounts and the PCs of users who do a little "recreational work" on the Internet still get loaded down with spyware, so it's entirely possible for this to happen.

Let the CEO of 180 get on the stand, take the oath, and then state that their software is not a threat and doesn't monotor the user. Let's see if they're really willing to put it on the line if they will be personally subjected to the consequences of misleading statements.

I have no reason to believe the CEO of 180. I'd believe the coders at Zone Alarm, whose product is seeing 180's software monitoring the keyboard and mouse, and responding!

We have ZoneAlarm firewall on our home PCs, and are very happy with it. At work, I have to deal with cleaning PCs infected with crud like 180, claria, whenU, and so on; thanks to ZoneAlarm, that's not an issue at home. Thanks, Zone Alarm!

My take on 180 and their ilk is simple.

If I find a program installed on my computer that
got there without my permission, I'm angry.

The best analogy I can think of is finding that
someone has their hand in my pocket, and is in
the process of pulling out my wallet.

No matter how much they protest that they were
not going to steal my money or tell anyone my
credit card numbers, their hand *WILL* be removed
from my pocket, immediately.

Of course, the situation with 180 does not also
provide me the option of breaking their arm.

Too bad.

Perhaps what is needed is an independent 3rd-party organization along the lines of the Better Business Bureau or the three national credit reporting bureaus that we all have to live with. Let that new organization (the Better Software Bureau?), in cooperation with the anti-spyware industry (Symantec, Zonelabs, Microsoft, etc.) develop and stay on top of a strong set of industry standards defining adware, spyware and scumware. The proposed organization could support itself by charging the anti-spyware vendors for access to its up-to-the-minute spyware registry. The vendors in turn would be able to distribute updated definitions for their products that would be based on the organization's registry. There would have to be a formal mechanism for ad/spy/scumware vendors to appeal their registry status, but the proposed organization would be beyond the reach of legal threats and tort lawyers, just like the BBB, Equifax, Experian and TransUnion.

There have been some serious, highly publicized examples of the credit bureaus refusing to properly remove errors from credit reports. So, the people affected sued. In one case, (I can't remember the details), a woman who's credit was severely trashed won $6.4 million from one of them...

Credit bureaus aren't immune from lawsuits.

Credit bureaus may not be immune to legal action, but the businesses that use credit bureau reports as a basis to deny credit are relatively immune. What needs to be protected in a similar fashion is the ability of Symantec, ZoneLabs, Microsoft and other antispyware vendors to maintain credible, effective products that can protect computer users from the scumbags--and the actions of their slimebag attorneys.
