Does Sony Own Your PC?

The entertainment industry's war to conquer our computers with DRM is obviously getting into high gear. But while it's good that a warning was sounded this week about a sneak attack from Sony, we shouldn't focus so much on that we ignore the juggernaut that's coming at us from the other direction.


The revelation by Mark Russinovich at Sysinternals that Sony BMG was infecting customers' PCs with rootkit-like DRM from some of its music CDs was certainly an eye-opener. We've seen this attitude on the part of Sony's music arm before (see "Dumb DRM Gets Boost From Sony Music CDs"), but it's still pretty flabbergasting when you think about it. That a media giant like Sony would so blithely put its customers at risk for all manner of security and performance problems, punishing those who actually bought their CDs while not hurting the P2P pirates one bit, seems almost incomprehensibly stupid. That is until you realize that, as always seems to be the case with DRM, the vendor's goal isn't really stopping piracy but gaining control over their customers.

And speaking of media giants gaining control our PCs, PC World had a very interesting story last month about another effect of the entertainment industry's DRM. It appears that the next generation of DVDs, be it the Blu-ray specification Sony is pushing or Toshiba's HD-DVD format, are going to require devices that support HDCP (High-bandwidth Digital Content Protection), a content protection scheme devised by Intel. Attempting to use the disks on devices that aren't HDCP compliant will result in either a low quality display or no display at all.

One problem with this is that almost all computer displays and even many HDTVs that people own now aren't HDCP-compliant. You may have just spent a couple of thousand on a wide-screen desktop monitor in the reasonable expectation you would be able to watch high definition video content on it in the future, and that's just too bad for you.

Even if you do have a monitor that supports HDCP, you're also going to need to use an operating system that implements DRM to police it. Windows Vista will include this copy protection scheme, known as PVP-OPM (Protected Video Path Output Protection Management). That means that XP Users who want to view the HD disks will have to upgrade to the new OS. Now, this isn't Microsoft's fault, but they probably won't be too unhappy if it gets some customers to migrate to Windows Vista who wouldn't otherwise. And since Microsoft never saw any DRM it didn't like, how long will it be before PVP-OPM is added to its own growing array of Windows copy protection schemes?

That's what really scares me about this whole deal. Personally, I can live quite happily without the movies Hollywood cranks out these days, and I don't see how anyone would want to purchase a CD from Sony BMG now. But if enough of the institutional powers get behind these various DRM schemes, how long will we actually have the choice of saying no to them? After all, not only is there a possible payoff for Microsoft, but the other parties who have been wrangling over the future of digital content may well like the idea of forcing us all to buy a mew heavily-DRMed generation of computers and other electronic equipment. The electronics and PC manufacturers can sell us a host of new gear while the movie and music industries get to dictate how that gear is designed. Hey, there's a little something in there for all divisions of Sony.

And there's one other institutional power that might have a hand in making sure we have no choice but to accept this DRM-laden future. Congress is desperate to push digital TV on us all so it can auction off the analog spectrum. And there no doubt will also be a lot of paydays for individual Congresspersons when the lobbyists from the media giants come around to thank them for all their good work. Hey, it looks like it could be a win-win-win-win ... unless you happen to be a consumer who wants to have some control over the technology products you buy.

Time to turn Luddite[ Reply to This ] (none / 0) (#2)

If this is what the future of tech has in store, I think it's time for me to turn Luddite - if I can't use tech without it controlling me, I'll have to learn to live without. As Ed said, living without today's movies is hardly a sacrifice, and the same could be said of the bulk of today's music. I wanted to expand on the first paragraph. It's actually not flabbergasting at all that Sony would do this. It's no surprise when you realize that Sony - like most other big companies - doesn't care about their customers at all, doesn't care about their customers' computers, and doesn't care about their customers' security. They care only about shareholder value, and once they have the consumer dollars in hand, they have all they need. Only pinning them with the liability for the results of actions like this will change anything - and even then, only if the cost of that liability overwhelms their "perceived" benefits from this tech. That these companies want greater control over their customers is nothing new, though computers make all kinds of new, more insidious control possible. What's disheartening is not that Sony is doing this, but that more and more of our courts are ruling this sort of rape of consumer rights as legal.

To my knowledge every copy protection scheme has been instantly circumvented.  Those who want to pirate won't be slowed down in the slightest.

The music industry claims that DRM is needed to protect their sales(profits). Two economists produced a paper that concluded that online filesharing did not adversely affect CD sales. (http://www.unc.edu/~cigar/papers/FileSharing_March2004.pdf)
Based on this research, it is difficult to legitimize the use of DRM.

They can stick there blue ray and hd dvd right up there shit pit for me, and as far as sony goes with there disguised hackers birthday software they can keep there music cds i will start to download instead. If this is progress they can keep it, i wil go back to the zx spectrum if i have too.

Oddly enough in this situation Intel would be the greatest looser's as simply consumers will get the message about HDCP and simply vote with their feet. Intel will probably only sell a handful of these to the media companys and the rest of us will vote with our wallets and tell them where to shove it. So if the HDCP had anything else going for it, that will be too bad as they will not sell a single one to a consumer with attitudes along the lines of what Sony have just tried to pull off. Get over it. Sony you do not have the rights to the internet or our PC. We are the ones who "LET" you use your products for "OUR" enjoyment on "OUR" PC's. If you media people try to stop us from doing what we have done for the past 15 years on OUR pc's you simply will get shafted and you will not be able to sell or even give-away a single music product. Simply because WE tell you what you can do. You cannot use a ROOTKIT to ROOT us. We can guarentee you will be the one who WE ROOT.

On PCMag.com's message board, with a link to what the software does and how the guy found it, he had to get REAL technical just to find the stuff, and even more so to remove it without completely crippling his computer. Hopefully the "masses" will start waking up and prtesting this crp like the rest of us do. Hollywood and the music industry are signing their own death warrants with this crap...

Sony's rootkit cd's represent a threat to PC users for years to come. Sony should immediately recall and replace every one of the CD's involved. Sony must be proactive else they could be liable for damage to computer systems for as long as the rootkit CD's are in circulation.

Isn't hacking someones computer without their consent to obtain root-level privelges an illegal act? Oh right, they claim their EULA gives them the right to do this. Hey, does that mean I can perform illegal acts if I contract with someone to perform them? Maybe I can go around door-to-door with an innocuous-looking petition gathering signatures, but buried in the dense text on the back of the petition sheet will be a clause that says I can enter a house and take things while the owner is away! Think I'd get away with it? Somehow I doubt it.

On a related note, isn't it also against the law hold a person's computer hostage? By far the most ominous note in this story for me is that Sony will tell you how to remove the software - IF you call their Big Brother line and convince them that you have a good reason for doing so. What if they decide not to let you do it? How is that different from a software vendor remotely disabling a product you have already paid for, which I believe is currently illegal? This is worse actually, since Sony is monkeying with software and hardware you HAVE NOT PAID THEM FOR.

Sometimes I think what we need more than anything is a corporate justice system with some real teeth; one that could do to corporations what our criminal justice system does to individuals. Imagine if the penalties for speeding, embezzling and murder were all the same - a ticket. Sure, the fines might range from $5 - $500, but you wouldn't really need to fear penalties harsher or more disruptive than that. Occasionally you'd face a greater threat from private law enforcers (lawyers) that people could hire at great expense, but their only power over you is to levy somewhat larger fines. That's the world coprorations live in when it comes to wrongdoing. Where's the corporate incarceration? Where's the corporate death penalty?

If you want to see a corporate death penalty you need only look for Arthur Anderson (The CPA firm). They were destroyed by the filing of criminal charges against them, sadly for their employees and partners when the Supreme Court ruled in their favor the business was already dead.

Writing in Freedom to Tinker, Princeton professor Ed Felten takes Sony BMG and First4Internet to task for their "fix" to the Digital Rights Management rootkit they used to protect some new music CDs (see "Sony reconsiders policy on hiring 'reformed' hackers" and "Sony DRM: You can look but you can't touch"). Seems the patch may have made an already bad situation worse. "[Sony] released a software update that they say 'removes the cloaking technology component that has been recently discussed in a number of articles,' " Felton writes. "Reading that statement, and the press statements by company representatives, you might think that that's all the update does. It's not. The update is more than 3.5 megabytes in size, and it appears to contain new versions of almost all the files included in the initial installation of the entire DRM system, as well as creating some new files. In short, they're not just taking away the rootkit-like function -- they're almost certainly adding things to the system as well. And once again, they're not disclosing what they're doing. No doubt they'll ask us to just trust them. I wouldn't. The companies still assert -- falsely -- that the original rootkit-like software 'does not compromise security' and '[t]here should be no concern' about it. So I wouldn't put much faith in any claim that the new update is harmless."

Calif. Lawsuit Targets Sony
A class-action lawsuit has been filed on behalf of California consumers who
may have been harmed by anti-piracy software installed by some Sony music
CDs. A second, nationwide class-action lawsuit is expected to be filed
against Sony in a New York court on Wednesday seeking relief for all U.S.
consumers who have purchased any of the 20 music CDs in question.

Experts say the Sony CDs use virus-like techniques to install digital rights
management software on computers. Windows users cannot listen to the
protected CDs on their computers without first installing the software,
which hides itself on the users' system and cannot be uninstalled by
conventional removal methods.

The California lawsuit, filed Nov. 1 in Superior Court for the County of Los
Angeles by Vernon, Calif., attorney Alan Himmelfarb, asks the court to
prevent Sony from selling additional CDs protected by the anti-piracy
software, and seeks monetary damages for California consumers who purchased
them.

The suit alleges that Sony's software violates at least three California
statutes, including the "Consumer Legal Remedies Act," which governs unfair
and/or deceptive trade acts; and the "Consumer Protection against Computer
Spyware Act," which prohibits -- among other things -- software that takes
control over the user's computer or misrepresents the user's ability or
right to uninstall the program. The suit also alleges that Sony's actions
violate the California Unfair Competition law, which allows public
prosecutors and private citizens to file lawsuits to protect businesses and
consumers from unfair business practices.

Himmelfarb was on a plane at the time of this writing and could not be
reached for comment.  But a court-stamped copy of the lawsuit he filed is
online here (PDF).

Scott Kamber, an attorney in New York, said he plans on Wednesday to file
class-action suits targeting Sony under both New York consumer protection
statutes and a federal criminal statute that allows civil actions.

"This situation is particularly egregious and surprising from a company that
should be familiar with concerns people have with programs crashing their
Windows computers," Kamber said. "What Sony is saying with this software is
that 'Our intellectual property is more deserving of protection than your
intellectual property,' and Sony can't be allowed to get away with that."

Sony spokesman John McKay declined to comment on the suits.

I wouldn't be surprised if other lawyers and law firms around the country
are also preparing to file similar suits.

As I wrote in a story last week, "Sony's move is the latest effort by the

feature that could also be used by attackers to hide viruses and other files
on a user's computer, and that conventional means of removing the
anti-piracy software renders the user's CD-Rom drive inoperable.

In response to public criticism over the invasiveness of the software, Sony
last week made available on its Web site a "patch" that would prevent its
software files from hiding on the user's system. But according to further
research by a variety of security experts, that patch can lead to a crashed
system and data loss.

Good to see a suit was filed against Sony; unfortunately, unless the settlement is for a really huge amount, it won't deter their behavior.

One thing that would really help eliminate the DRM crap is to target the mass-market retailers that sell the majority of the CD's. If Wal-Mart, Target, Best Buy, etc... were named in the suit as well for knowingly selling defective CD's, they could put HUGE pressure on the labels by refusing to sell DRM-protected CD's. Of course, it probably won't happen, I'm sure the chains get massive amounts of "co-op/advertising" funds from the major labels. But it would be one good thing a company like Wal-Mart could do for consumers. Putting pressure on their suppliers is what they do for fun and profit.  :)

As I have been following the links to the various blog, other (non-Sony) CD users have reported that their CDs would not work with DRM enabled CDs. This leads me to speculate (paranoia) on a couple of points. What happens if the DRM technologies employed by the various companies are incompatible? Even worse, dirty tricks, company A's DRM actually kills company B's DRM.

Sony's rootkit is only one incident in a long line of decisions that have led me to boycott the company. They further compounded that mistake by the then-CEO of the media division saying "Most people don't know what a root kit is, so why would they care?"

Add to that the following:

-ATRAC, Memory Stick, MiniDisc, UMD, and every other proprietary format that Sony tried to foist on the public, thinking that the Sony name would get them the sales, and that they could then force others to license Sony proprietary formats for big bucks. We all know how that went over --exactly like IBM's PS/2 with Microchannel line of computers.

I don't know about you, but when a company attempts this kind of deception, they don't deserve my trust. Sony has also propagated other "astroturfing"-type campaigns in its history for its various Playstation gaming platforms.

-Finally, looking at several large-scale recalls of laptop batteries manufactured by Sony, and CCD's used in many brands of digital cameras (these CCD's also manufactured by Sony), one could say I find their quality control suspect as well. There are only a few products I believe that they do exceptionally well at this time (e.g., their Bravia televisions); many others have slipped in quality from what Sony was as a company two decades ago. Since I can find other products of equal or better quality than Sony for a lower price, it makes it even easier for me to boycott Sony as a company until they someday realize that consumer-friendliness is the only thing that will allow me to consider purchasing a Sony product.

To hell with Sony, its not enough for them to sell overpriced electronics and cry about getting ripped off by the P2P bunch. I say don't buy anything from them. Congress has sat on their fat asses for to long, 2008 election isn't that far off, get rid of every one that been in more than two terms. Than make the new congress write laws to protect the consumer and punish lobbyist. Is there an actual Blacklist on the web, if so where is it. If not how can one be started.
