NetZero Still Has Award-Winning Sneakwrap

In our never-ending search for the worst terms on the Internet, one reader recently spotted a new candidate. Well, not entirely new, because we looked at NetZero's terms quite a while ago. But, even for those who are willing to pay for their Internet service, NetZero's terms seem to have gotten worse.


The reader was interested in NetZero's paid services until he ran into this provision in the terms of service:

Software Downloads. As part of the NetZero Service, NetZero may from time to time download software owned by NetZero or third parties to your computer. Your use of the NetZero Service constitutes your consent to such downloads.

"Apparently even for the paid service, they still want control of your PC," commented the reader. "All I found was an automated 800 number, so I was not able to ask NetZero why they needed to download any third party software to my PC. Guess what, I will be looking elsewhere."

While the Software Downloads term alone ought to put off any customer who is willing to pay for an ISP, even those who figure there's nothing to lose in trying the nominally free NetZero service might want to look closely at all the NetZero "Rules" which apply. There's some scary stuff in the privacy policy rules, like how your "psychographic information" and a "database of the types of sites you visit while you are online" can be used to better serve you ... oh, and NetZero's advertisers and business partners as well.

But, as we saw over four years ago, the real problem with NetZero's terms is that they are the very epitome of the sneakwrap concept. As was the case back then, NetZero's "Rules" still incorporate a number of documents totaling over 10,000 words of legalese. And they say that NetZero customers free and paid, are supposed to check all those documents whenever they use the site as they can change at any time. In other words, not only are NetZero's terms bad, they can get much worse at a moment's notice. And we use the word "notice" advisedly, since "posting of the updated Rules at the NetZero Site will constitute notice to you" of any changes.

I have one of those "free" NetZero accounts, now it's strickly my Spam address. Also have a Juno "free" account, now same thing. Juno used to be better as one could work email off-line. No longer, like NetZero you need to use their dialer which pushes ads and steals bandwidth. As I still like the idea of a "free" ISP dial-up for occasional use, I've switched to Access-4-free.

Not only does Juno require all their wonderful spamming They also will Lock you out of your machine if your account is closed and you have chosen to use another ISP or connection. Also they will charge you for their trial after you request it to be closed Months later I had a free trial I cancelled it I used the card that I signed up with JUST for bills for ISP and other thing online that had a monthly charge I only put the funds for those things in the account made my payments it was empty most time I Thinking since I called and cancelled Juno would never be charged WRONG they decided 8 months later to deduct a charge of 58.00 from my card because THEY claim I still had their service The first time I contacted them they apologized and in that same breath offered to give me three months free service BUT they would Not give my money back? Then after contacting more help there higher up and sending along a LONG list of links to gripes and complaints that I found online dealing with the SAME issue I finally got an apology and my money and darned if they did not AGAIN offer me 3 free months LOL Also the software had to be totally removed when I closed the account it locked me out of All connections Until all of Juno was removed I could not use any new connections It kept telling me I had to log in or sign up for Juno I stay FAR away from them and net Zero who took my neighbors check cashed it and would NOT open her account for two months Yet charged her for the time even though she never had access LOL That bunch well they are a piece of work. I never read the part about adding stuff to my computer maybe that was new or maybe that was why the machine locked up and would not allow me to use any service but theirs Personally I always felt they were the cheaper version of AOHELL Just my thoughts and experiences

Akin to the NetZero terms, I believe it was Juno whose TOS for all practical purposes gave them ownership of your computer. You were required to run their distributed computing app whenever you weren't using your computer for something else, rather akin to applying your unused CPU cycles to SETI-at-home or distributed cancer research.

There are several problems with that, above and beyond "just whose computer IS this anyway??" What if the distributed computing is for something that you have an ethical gripe with? What if it is for something that is illegal in your locale and could get you into serious hot water?

As to NetZero's "can download whatever we wish to your computer" -- judging from the rest of their TOS, this probably means various species of adware and/or spyware, tho it could refer to a distributed computing app.

10,000 words is far too much to read for me. I admire the reader who actually read the detail. I find this intrusive policy of "we'll put whatever we want on your computer" so offensive that I would purposely avoid amything having to do with NetZero. If I knew NetZero's "partners", I would punish them by avoiding their firms as well. On the other hand, I pay a $45/month price for dsl+dialup internet access and have no clue if such a set of verbage is part of my agreement! I am politically conservative, but this kind of unconscionable activity on the part of an ISP is enough to make me vote liberal to stem this arrogant abuse of power.

Why? Populism, fiscal resposibility, and anti-corporatism/elitism is part of the core conservative ethic. It was the foundation of the Republican party before they sold out their values, and now the only place you're likely to find it is in splinter parties and occasional holdouts among the old guard; you're as likely to find liberals paid off by lawyers as conservatives.

Not to tell you to vote one way or the other, of course. :p

I used free Netzero for two years, but moved to the paid version in 2002. I think the NZ TOS sounds worse than it actually is. I have not been bombarded with ads or anything else. I have found NZ to be inexpensive and very reliable. Their service link responded quickly to my only question. I wish NZ (and all ISPs) would add a malware filter, since they are the bottlenecks through which such things must pass. Ace

Well, it's nice that they haven't yet screwed you over, but the point is they specifically give themselves the right to do so, in any way, at any time. That's not OK. If they genuinely plan not to use their noxious powers, then they should take them out of the TOS. Simple.
