Activation Good for Only 90 Days

One concern users have about the spread of product activation is how long the software company will support it. How about 90 days? That's the answer one reader got involving an apparently defunct activation scheme on one of the most venerable programs of them all: Print Shop.


"Broderbund is a company synonymous with various products including the legendary Print Shop publishing software, which I have used since its early inception," the reader wrote. "Having gone through the various upgrades over the years brought me to their Version 20 of the software. I purchased this product early last year directly from the company, which sent me a set of CDs that needed to be activated over the web. I figured no problem since it saved me shipping/handling charges and I already had the media in my hands. I went through the web ordering process with my credit card and after registering I was able to log-in and the software was activated from the web."

All was fine until the reader experienced a hard drive crash and needed to re-load his application. "When I went to the Broderbund site I was informed that I needed to enter an e-mail address and password, whereas before I had registered with a user ID and password," the reader wrote. "Since I did not have my account set up with an e-mail address, I was forced to call their customer service for assistance. When I finally got through to a human being I explained my situation to the representative on the other end. He informed me that Print Shop is no longer activated through the web and it would cost me $5.99 to get the actual CDs in the mail in order to re-install. Again, I already had possession of the original CDs, which evidently would only work with web activation. He also stated that web activation was only guaranteed for 90-days from the purchase date of the product. Didn't I buy a license to use their product? By Broderbund no longer providing web activation, aren't they stopping me from using the product I already paid for?"

But $5.99 for a new set of CDs wasn't all the reader was out. "I also had purchased American Greetings CreataCard Version 8 from Broderbund as well early last year," the reader wrote. "As you may guess, I also needed to re-install this software after my hard drive crashed, and again I had used web activation. In this case the same rep informed me that Broderbund no longer had a business relationship with American Greetings and would not be able to provide me with new CDs as was the case with Print Shop. I told him that's fine and just give me a contact at American Greetings to talk to. He then proceeded to inform me that Broderbund handled the actual CD publications, distribution, and product activation for American Greetings and there is no one for me to talk to and there was nothing he can do for me. So I asked him if I'm basically stuck with a useless piece of software which I had legally purchased a license for and activated on-line as I was supposed to. He confirmed that's the case."

The reader grudgingly ordered the new Print Shop CDs for $5.99, but he wondered how Broderbund could just eliminate the registration system they'd been using when he bought the product. "According to the Broderbund rep, they had a statement in small print at the bottom stating the activation is only good for 90 days," the reader wrote. "He may be right -- I just don't recall seeing it. The other issue I argued with him about is that I never received any e-mail stating that their activation policy was changing. He agreed and apologized for that. It's bad enough to charge me $5.99 for receiving for another set of Print Shop Version 20 CDs without on-line activation; however, it's totally unacceptable to simply not be able to use my CreataCard software anymore. As you may expect, I will never buy another package requiring online activation nor will I ever buy another Broderbund product again."

The reader's experiences with both products certainly raise a number of questions. Do current versions of Print Shop require activation? Does someone else now publish CreataCard? And how can software customers protect themselves from activation schemes that vendors stop supporting? Unfortunately, my repeated calls to press relations officials for RiverDeep, the company that now owns the Broderbund brand, were not returned. So I guess we're just going to have to see if we can answer such questions for ourselves.

This type of business practice is only tolerated because people put up with it. Fill out a complaint with you State Attorney Generals office. Have them investigate. If you paid the money for the new disks on you credit card as well as the original software, dispute the charge and write your card company. Let them defend their actions. What is next, does the new software allow them to deactivate it unless you start paying $5.99 a month.

This is how software used to work in the 60's and 70's, and is where Microsoft wants us to go today (to paraphrase their ad campaign).

It has been written that Microsoft tried to implement this feature on Windows XP and Office XP - it was to have taken effect in October 2002. However, many corporate customers complained (quietly) to his Billness, and Microsoft chose to hold off ... for now.

Why do you think Microsoft implemented product activation starting with those two products along with Microsoft Passport, the repository of your username, password, and financial (banking and credit card) info?

It has been written that the original idea was to have everyone require a MS Passport, and then, with a EULA change on the website, begin charging your credit card or EFT a fee of $12.95 per month for Windows XP and a fee of $7.95 per month for Office XP.

Sources indicate that Microsoft has inferred that they WILL begin this process in 2006, corporate America be damned.

So, enjoy that illusion of software ownership ... for now!

Not quite true. As a former avid ebayer, the limit on chargebacks is a minimum of 60 days, with some extending it to 90-120. As well as having to be over $50 in most cases.

This cannot be true. If you purchase an item on the 1st day of your billing cycle, your bill won't be printed for another 28-30 days, plus a few days for it to be mailed and reach you. You may not see a credit card invoice containing a particular purchase for well over 30 days of the purchase date. The minimum almost has to be at least 60 days.

The 30-day limitation is not correct. I think the actual time period is defined as 60 days from the day you first receive the statement with the charge on it. That's the minimum time frame you have to request a chargeback. Many card issuers are more flexible than that; I suspect for cardholders they value the most, they'd be much more accomadating with chargeback requests.

I did a chargeback with AMEX a couple years ago, they sent a survey a few weeks after the process was done. One of the questions was would you have closed your AMEX account if the chargeback request was declined? I answered yes.

I'm sure MS would love to do this, but I have my doubts. There have been more than a few cases where large organizations (governments and corps.) strongly considered moving to Linux and not renewing their MS volume license agreements. In many cases, MS offered huge discounts to keep them as customers. In other cases, MS still lost them as customers, and they went to Linux. If MS was to actually implement a monthly/annual fee, and require activation from large corporate customers, I suspect we'd see more than a few of them loudly protesting, and begin switching to Linux. Or, they'd simply continue to use their older versions of Windows. Many organizations still run NT4, despite the pressure from MS to upgrade.

At least the new charge of $5.99 could be put into dispute, with the buyer demanding that Broderbund prove that they had the 90 day limit when he made the original purchase. How hard is Broderbund going to fight over $5.99? Also no matter what your credit card bank may tell you, chargebacks can be done 6 months or even a year later at the bank's discretion. Amex is the best credit card to use, you just tell them on the phone to open a dispute.

It's not a shock that Riverdeep failed to return the writer's call. Riverdeep also failed to pay their leases on various office spaces, inform their employees that they are about to be fired, and best of all they also break contracts with school districts that spend thousands on educational software on a regular basis. Don't buy products under the Broderbund, Learning Company, or Edmark brands because they are all owned (and eventually dismantled) by the same crooked group...the RiverCreeps who pulled their company off Nasdaq and ran back to Ireland to find someone new screw before the axe fell in the US. I give them 4-6 months before they package it all under a new name and try it again here in the US.

I find it very funny and ironic that while Broderbund is being slammed here because of their criminal activities, Google Ads is advertising them at the top of their list on this page. Personally I'm going to find an alternative for the rest of my family now using their software.

I find it ironic that this type of software "support" is what's (not) provided for people who PAY for a legal copy of the software. Broderbund's policy (and others like Intuit, etc.) are encouraging folks to obtain the same software using less legal means. No restrictions apply with them.

This is true.  They are actually encouraging piracy with actions like this.  I have two copies of some programs.  I have a legitametly purchased CD, which is in storage.  I also have a pirated version, which is installed - and doesn't have the activation BS.

The CD key works, and it's legit (I purchased it), but I don't have to dance to their marriot-string pulls.  If my HDD crashes, I just reinstall - no "reactivation" scheme required.

I would rather not have to do this, but I'm also not going to go through "product activation."  

For a long time, businesses have looked for a way to force users to register.  I think "product activation" is their answer.

They (businesses) think it reduces piracy.  It actually probably increases it.  I looked into P2P when I found out about XP's product activation.  

Another thing encouraging piracy: New PC's, because of MS's requirements, no longer come with an OS installation CD.  So, "roll your own."  You purchased a legit license with the PC.  Why should you be presented with a Faustian choice?  Your choices are to either roll your PC back to the purchase config, or buy a second OS CD.  Instead of these two non-choices, why not use your legit license, store your "recovery" CD, and download a pirated version.  Create your own OS CD.  And don't worry about product activation.

Maybe you don't think the above is ethical, but I don't have a problem with it.  You payed for the software, why not be able to actually use it?  I suspect most people feel the same way - and is one reason piracy appears to be increasing.  The software companies are bringing it on themselves!  People are finding work-arounds to odious terms that companies are trying to force down our throats.

Games require the game CD to be in the drive to play.  This wears out the CD, and is a nuisance.  So, I download the no-CD crack and play with that.  When I do an upgrade of the software, I just restore the original (CD requiring) exe.  Then, I get the new no-CD crack.  It's stupid and annoying!  But, then again, I find I don't play those (few) games that I don't have the crack for.  I find finding the CD and inserting it into the computer to be more of a hassle and just not worth it.

I didn't used to know anything about software piracy, but the software hijinks that keep coming have pushed me into learning about it!  (I still don't know much, but I know enough.)

When the terms become more fair and balanced, then I think piracy will decline.

The horror of the situation is when viruses and spyware infect your recovery partition. Without a read-only disk, you're screwed, with no recourse except an often unresponsive OEM. Given the history of viruses, you wouldn't think it'd be so surprising.

In a similar fashion, I mostly play PSX games on my PC since the PSX broke ages ago - it's more convenient to save anywhere anyway, though PSX emus aren't nearly as featureful as SNES - and it's much faster to rip to the hard drive to play. So I'm doubly violating the letter of the law for more convenience to play games I bought on a system I bought.

I've downloaded a few games, but bought most of the ones I liked and junked the rest, just like renting.

A friend of mine was having trouble reinstalling 321studio's DVDXCOPY, turns out they're out of business. I had no problem finding a keygen for him. The downside is that I think this is slowly convincing more people (myself included) of the legitimate need for a cracker scene as the only effective consumer advocates against a steady erosion of rights and privelidges.

I only buy PCs from companies that give me a legitimate Windows CD, not a "restore" CD.  In fact, I was looking into one of those little Fujitsu touchscreen laptops a couple years ago, and I balked precisely due to this issue.  They actually send the machine with a restore _partition_ on the hard drive, not even a CD, and suggested that I purchase additional software to allow me to back up the partition!

If people quit buying under such conditions, these conditions wouldn't exist.  Fujitsu lost the sale of a $2000 or so machine due to a missing $3 CD-ROM.  Their problem; NOT mine.

I would have never gotten into piracy if it wasn't for all those stupid activation schemes.Now I refuse to buy a game that I haven't already played the "cracked" version.I used to buy a LOT more till the EXTRA stupid "keep the cd in drive" game crap.Who wants to have to pile up a dozen game discs around their pc and play the cd swap dance just to play a game?THANK GOD for all those little broke russian crack artists.

also, these licenses almost always say the license can be changed by the software owner at any time for any reason without notifying the other party (or, just by posting it to a web site, same difference) - there is likely no legal recourse, because they hold all the cards - the consumer has absolutely no power other than take-it-or-leave it, because these liceneses get only more egregious as time goes by, and there is zero reform or even an attempt to be customer-friendly - who needs customers?

For years I have sold and used packages that use a dongel (key, sim) that plugs into a parallel port or USB port. People used to complain about these protection schemes also. But a user can easily move these keys to any PC, any time. They are perfect for the guy who works at multiple PC stations. I can still only run one PC at a time, but I choose where I do it. Software activation locks you to a PC. Even if your the only user of the program, the flexibility of working at home or the office is gone. They expect you to buy a package for each PC even if your the only user. That's just wrong. I'm convinced that software activation only hurts the honest user. A bootlegger will always find a way around protection schemes. The honest user who paid hard cash will get punished by software activation everytime. I will not buy any more programs that require software activation.

The Steam thing that comes with HL2 is not your average activation scheme, it should be noted. In some ways, it's more like a dongle -- where the "dongle" is actually a remote server connected via internet, rather than USB port. You can move to other computers, but you can only be logged on to Steam as a particular user from one at a time. Of course there are differences. Needing a functioning network connection is one of them. The possibility of remote deactivation is another. On the plus side, the availability of auto-updates of bugfixes and the difficulty of cheating online. (And contrary to popular belief, it does appear possible to turn the auto-updating off, though you probably can't play on multiplayer servers without it being up to date.) If all activation schemes had 3 characteristics there might not be so much objection to them... 1. Activation can be easily transferred, but is limited to one system at a time per license. 2. Activation is robust -- if the activation server is down at some point it might not be possible to transfer or reinstall until it's up again, but a functioning install won't spontaneously deactivate because of this. (Steam does not meet this criterion however. In offline mode it functions for only seven days, rather than indefinitely, before needing to contact the server again.) 3. There is no remote deactivation, and when the activation server is EOL'd the software is freed to function and be reinstallable and transferrable without activation. (Better yet, they should take a page from id Software's book and open source their older code. It's probably obsolete and no longer a revenue source anyway, so why retain control? Admittedly, id could go one better and open source the game content (textures, maps) that's gotten old too. They don't, and I don't know why, since it's also become obsolete -- all the newer games, theirs and otherwise, are using much higher resolution textures and other art after 4 years or so. The old Quake 1 textures might as well be freed since they've been superseded by super-hi-res doom 3 textures with bumpmaps and glossmaps and other such accessories. In fact this is really an argument for making the copyright terms, at least on software, factual material like news stories and textbooks, and such very short (1-4 years) and on most other things a decade at most. And disallowing patents on software, business methods, etc. -- you shouldn't be able to patent an *idea* any more than you can copyright one, only a specific realization, but with these egregious patents you can. This goes for biotech too -- what is with drug and gene patents? I can see patenting specific methods of manufacture, but drugs and genes themselves are really just data. Ones with about 4 billion years of history shouldn't even be copyrightable, and the rest should be but with limited terms. And with actual instances of the molecules not considered as possibly infringing, only the manufacture of them without license. Of course sooner or later we're in a world where anything can quickly be built from a data template, and then only copyright makes sense, not patents...

I just read the comments of the user who was unhappy with answers offered by Broderbund. I, too, have had the same trouble. I have used this software for quite some time, always upgrading, etc.. This is the best, ever, for publishing photos and, easily, adding text under them for wonderful scrapbooking. My pc had to be replaced and when I re-loaded my software, my CreataCard 8 came up as "locked". I called Broderbund and was told that this product had been discontinued. I, too, felt I had purchased a product with a user license and I should be able to have it re-activated!!!! I did call American Greetings and they offered me a free, one year, subscription to their "create and print" software. I was anxious to try this to see if it was comparable to the CreataCard software. I can't get it to work, but in looking at what is offered, it doesn't appear that I can import my pictures on a blank page and add text, as was so easy to do in the Broderbund software. This is very frustrating as a person should be able to use something they've paid for................. Is this a case for the Better Business Bureau? What recourse is there, if any?

I too am very upset eith this company. My pc crashed due to another software company's fault. I use a backup program as well. My creatacard software is also locked! Everything is on my hard drive, but when I try to run the program, I get this message: Executable not available, try unlocking again. It seems totally ridiculous for them to be locked when I have bought and paid for all of these versions. I too, contacted Broderbund and was told they no longer support the software and suggested a slight discount for The Print Shop. Why would I purchase another program from them, when they don't honor or support the previous programs?
