The Terms
As distributed in August of 2004, the AutoCad 2005 end user license agreement read:
3.1.1 Backup Copy. Regardless of which version of the Software You have acquired, You may Install one archival (backup) copy of the Software. Such archival copy may not be Installed on another Computer, unless such other Computer is a partitioned drive of a server to which only the user of the active copy of the Software can Access. In any event, the archival copy may not be Accessed as long as another copy of the Software is Installed on any Computer. Except as expressly permitted under Section 2.2: (a) if the User Documentation is in printed form, it may not be copied; and (b) if the User Documentation is in electronic form, it may not be duplicated electronically.
3.1.2 Additional Installation. Except with regard to Educational Institutional, Student and Evaluation Versions only, You may Install and Access a second copy of the Software on the hard disk of a second Computer owned by You or under Your control provided that:
(i) the original and second copies are used only by the same person;
(ii) the second copy is Installed and Accessed only on either (a) with respect to Network Versions, a redundant server that makes the Software available for use only when Your primary server on which the active Software copy is Installed becomes inoperable, or (b) a notebook computer or other non-server computer away from Your usual work location for the purpose of enabling You to perform work while away from Your usual work location;
(iii) only one of the Software copies is Accessed at any one time; and
(iv) both copies of the Software are Installed and Accessed exclusively with the copy protection device (if any) supplied with the Software.
As distributed and posted on Adobe's website in August of 2004, the Photoshop CS end user license agreement read:
2.4 Portable or Home Computer Use. The primary user of the Computer on which the Software is installed may install a second copy of the Software for his or her exclusive use on either a portable Computer or a Computer located at his or her home, provided the Software on the portable or home Computer is not used at the same time as the Software on the primary Computer.
2.5 Backup Copy. You may make a reasonable number of backup copies of the Software, provided your backup copies are not installed or used for other than archival purposes.
Comparison
Adobe's language is relatively short and sweet, but both EULAs allow the individual user to use the license on a second computer as long as it's not being used on two systems at the same time. Part of the complexity of Autodesk's EULA comes from a structure that has it talking about various types of academic, networking and standalone licenses, but the substance in this case seems to be the same. So both Autodesk and Adobe deserve credit for being fair on this issue.
More for reference than anything else, I've also included the language from both EULAs that allows for making a backup copy. Now, copyright law expressly gives users that right in any case, so I don't think this is something that the EULA has to mention to make it so, and it doesn't effect my scoring. But I will note that Adobe actually says you can "make a reasonable number of backup copies" instead of only one, which is a nice touch.
My Scoring
Both AutoCad and Photoshop EULAs get one point to the good for explicitly allowing an individual to use the program on a home or laptop computer.
