No Privacy at Hilton Hotels

By the nature of their business, you'd think hoteliers would have some concern for their customers' privacy. To judge by their privacy and website terms, however, Hilton.com thinks publishing your credit card number is within its rights.


A few days ago, a reader was trying to book a room for the 4th of July at an Embassy Suites, one of many hotel chains owned by Hilton Hotels Corporation (HHC). "When I was about to reserve through their site, which was running a deal better than Travelocity offered, I decided to glance at the privacy clause," wrote the reader. "I found it to be quite interesting. Go to www.hilton.com and click on 'Privacy & Security' and then read section IV. See if I'm interpreting it correctly. The way I read it, all information that you submit as part of a transaction, like booking a room, is now theirs. They reserve the right to do whatever they want with the info, including publish it. That info would include my name, address, credit card number, etc. I booked with Sheraton instead."

Well, yes, I'd say the reader was interpreting it correctly. "You agree that HHC shall own all Information," Hilton's terms state baldly. Further, it says that "such Information belongs to HHC and is not personal or private proprietary information ... (and) may be processed, used, reproduced, modified, adapted, translated, used to create derivative works, shared, published and distributed by HHC in its sole and absolute discretion in any media and manner irrevocably in perpetuity in any location throughout the universe..." Nowhere in the 7000-plus words of what's supposedly a privacy policy does Hilton put any constraints or limitations on how it may use information supplied by customers on its websites.

All in all, it's a remarkable document. Not only is it the worst privacy policy from a legitimate company that I've seen, the identical document also doubles as Hilton's website "Site Usage" agreement. So along with claiming the right to use your information in any manner it sees fit, Hilton also disclaims all warranties, denies all damages, forsakes all responsibility for its negligence, requires you to indemnify Hilton and its partners against all legal actions, no matter how justified, that you or someone else might bring against it, etc.

Hilton's privacy policy/usage agreement even outdoes most software license agreements in claiming to represent a binding legal contract. At one point, it even states that in clicking OK to this agreement you almost surely didn't actually read that you "hereby acknowledge that you have been advised by your legal counsel" to give up your legal rights. In fact, as I was first reading it, I thought it odd how Hilton's legalese goes on and on about subjects like publishing rights and idea submissions that would seem to have very little to do with a hotel chain's website. There was something vaguely familiar about the language, as if ...

And then I saw why. Down near the bottom is a statement that your use of the site authenticates that you have entered into the agreement under the various electronic signatures acts and ... the Uniform Computer Information Transactions Act. Yes, UCITA rears its ugly head once again. It's almost as if whoever wrote Hilton's terms used UCITA and associated commentary as a template.

If you'd like to see Hilton's privacy/site usage terms for yourself, you have many sites from which to choose. Not only is it at Hilton, but what appears to be the identical document serves as the "Privacy & Security" and "Site Usage" terms at the websites for Conrad, Doubletree, Embassy Suites, Hampton Inns and more. Read enough of it to get the general flavor and I think you'll agree with the reader, and me, that it would be a good idea to stay at the Sheraton instead.

Update [2004-7-5 0:10:32 by Ed Foster]:Hilton has now posted a new, and far more reasonable, privacy policy on its various websites. The site usage agreement has also been modified, removing some of the terms referred to above. The version of Hilton's terms discussed in this story can be viewed here.

So, I want to change my web browser string to state that my privacy agreement overrides their privacy agreement, and that by accepting my http connection they agree to be bound by it. It will be right there in their web logs, where everyone can read it.

Google ads are context sensitive and automatic...it is expected that mentioning HILTON or Embassy Suites would get ads for them....

Hilton.com E-mail Form[ Reply to This ] (none / 0) (#4)

A few readers have pointed out something interesting. If you go to the Customer Support page at Hilton's website and try to fill out their "Email Us" comments form, your e-mail address and telephone number are required fields. So I guess they would become part of the "Information" that Hilton owns.

Here is the note I sent to Hilton Hotels about their totally absurd privacy policy. You may copy or modify and reuse it as you see fit. I have now carefully read the privacy notice provided on your site at this address:http://www.hilton.com/en/hi/info/privacy_security.jhtml. This policy clearly states that you have the right to resell my credit card and personal information to anyone you choose. This is unacceptable. I have directed my company travel agent to NEVER place me in another Hilton owned hotel until I receive written notice that you have changed your policy to protect my private information. I hope you understand that I, and my friends, family, and business associates all consider identity fraud a serioius problem, and we are intelligent to recognize that your privacy statement is contrary to our interests, contrary to good business principles, and totally unacceptable. I have enjoyed the Hiltons and Embassy suites I have stayed at. I am sad that I will stay there no more.

Unless I'm mistaken (I'm not a lawyer) banking laws will not allow credit card numbers to be published. And if they tried it, I'm sure the credit card companies would have something to say about it. Hilton would be in trouble if VISA decided not to let them accept those cards anymore...

People seem to have missed out on this point and it applys to more than just credit card information.

There are a whole bunch of regulations that prevent Hilton (or anyone else) distributing personal/financial information and it's not in their interest to do so anyway. Hilton makes billions of pounds every year selling bed and breakfast, do you really think they would make even a fraction of that amount selling your personal information? That's not the business they are in. They sell bed & breakfast, they are not an IT or marketing company.

The fact is, when you book a room you give your name, email address, postal/billing address and your credit card details. How do they use this? Your name & email address will be used for email marketing purposes IF YOU OPT-IN, your postal address and name will be used for marketing purposes and it's made pretty clear how to opt-out of this. Your credit card-details will never be used and held as securley as any other company.

And when you stay with them they also consider your personal life theirs to fully delve into, including your luggage.  Earlier this year I stayed 3 wks at a Hampton Inn on business.  As I'm HIV positive I take several medications.  Prior to leaving the hotel each morning I stashed the pill bottles back in the bottom of my suitcase underneath clothes and put it back into the closet.  The rest of my clothes were in the dresser.  There was no other indication of my "condition."

2 wks after I returned home I received a package with the hotel return address containing 2 religious books something like "Hope for the homosexual with AIDS" etc.  There was no note or anything written inside.  The hotel claimed they knew nothing about this.  Obviously someone had gone through my closed luggage, knew or researched what the medications were, and made their own judgements about how I contracted this virus (wrong).  Now per Hilton's privacy policy/usage agreement I guess the entire world knows.

You can't be serious. You think that the Hilton broke into your suitcase, located your piils and researched your medication? Those actions would go way beyond simple privacy issues. I find it very hard to believe there's not a much simpler explanation.

I just followed the Hilton privacy link in Ed's message, and noticed under section III "Restrictions on use of materials", the second sentence in the paragraph reads: "No material from the Site or any Internet site owned, operated, licensed, or controlled by us or our affiliates may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way." Unless my grasp of the english language isn't what it used to be, doesn't this sentence mean that Hilton is breaking its own usage agreement by posting, transmitting, and distributing its web site over the internet? If I print a copy of my reservation receipt (which the Hilton own web page would most likely suggest if one were to make an online reservation) would I then be in breach of Hilton's usage agreement and subject to the wrath of Conrad?

The legalese these days has reached the point of absurdity, and our court cases have basically become a test of who can outlast (e.g. keep paying their lawyer) the other. He with the deeper pockets shall win, and he with the most obscure usage agreement will be able to bury all adversaries in an endless stream of "court documents".

Good point "The legalese these days has reached the point of absurdity" thats why hilton has a privacy policy like that. There are people out there who make a living suing large corporations, really, the legalese.

It is time for consumers (including large companies that use amenities like the Hilton) to adopt their own privacy policies. Something to the effect, "By completing this transaction and accepting payment for the services rendered, payee agrees that all information regarding this transaction is solely and exclusively the property of the payer and shall not be used by the payee or disclosed for any purpose other than receipt of payment for services rendered. Any other use, including further promotions or sales of information to third parties shall violate this agreement and shall result in full reimbursement of all fees paid for such services. Receipt of payment shall constitute agreement to these terms" I'm sure a well-trained weasel ^H^H^H^H^H could develop such a legal statement and append it to all corporate payments to hotels, airlines, rental car companies, etc.

I just went to the link for Hilton's privacy policy and it looks like they have updated it.  If I'm reading the correct one it looks much better.  Maybe your article on this has paid off.

Symantec makes a firewall appliance that I think has an even cooler feature. It lets you hook up two separate fast internet connections. Thus you could hook up a dsl line and a cable modem to it. If one goes down, the other would keep functioning. Sure this will cost twice as much per month, but most of the time (when both are working) you will have twice the bandwidth. And the chances of both services going down at once are very slim. I believe it is their 200R product, info located at http://enterprisesecurity.symantec.com/products/products.cfm?ProductID=63&EID=0 ...This is going for about $600+ on ebay, but consider it an investment in your business. I've thought about replacing our $1,000 a month t1 line with one of these and a dsl/cable combo as described, saving $900/month! -Hugh

Did you read the policy? Why did you reproduce the policy in your follow up when it states clearly that III. RESTRICTIONS ON USE OF MATERIALS All materials contained in the Site are the copyrighted property of HHC, or its subsidiaries or affiliated companies and/or third party licensors. No material from the Site or any Internet site owned, operated, licensed, or controlled by us or our affiliates may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. To think that Hilton would publish your personal details or give them to third parties without good legitimate reason is ludicrous. Hilton takes privacy extremely seriously down to the point where they don't even allow use of third party cookies etc. The same applies to your personal details. Theres no company I know of that follows privacy regulations like Hilton. The privacy policy covers their back and prevents them from legal 'traps' and slander on blogs like this. If you care so much about privacy policies why dont you abide by section III. RESTRICTIONS ON USE OF MATERIALS and remove your reporoduction of the policy??
