A question that I've got is did Mr. Jones register an incorrect email address, i.e. did he use Mr. Smith's address in error? Working with a company that does have people register their email address, I can't even begin to tell you how many times people don't use the correct email address, they just assume that msmith@ hotmail is available, so they use it or they just don't double check what they've typed in or make the same typing error in the 2nd box for email address. This would mean that DirectTV didn't make an error to begin with, though they probably should at least flag Mr. Jones account as having an invalid email address. While it is easy to blame DirecTV for the problem, it is possible that the initial issue wasn't their fault to begin with.

Even if Mr. Jones entered Mr. Smith's email address in error, it's still DirectTV's fault, if they use it without verifying it. I'd consider anything that came from them, to an address other than the one I instructed them to use, as spam, and report it. If they start getting on a few block lists, that should get their attention. You can't just put a form on a website inviting the public to enter an email address, and feel justified in sending more than a request for confirmation, to that address, until the person on the other end of that address confirms it.

If Mr. Jones received the e-mail addressed to Mr. Smith, then it cannot be Mr. Smith's account.
