Why not a standard EULA that is incorporated by reference? If enough sompnaies could agree, that would help. Specifics such as Rawley's "Under the license you may: - Install and use Picnam on one computer. - Install and use Picnam on a second computer, if the second computer is normally used by the same person and the software will not be used on both computers at the same time." would be upfront and obvious, with the distant EULA reference the last item.

That isn't exactly new. Borland commercial software had a license-by-reference saying your rights were the same as with a book...basically, the normal division of rights under copyright.
