On a purely philosophical level, default opt-in to pay is just plain morally wrong. We don't accept it from spammers over being added to their lists. Dabamobile is counting on the likelihood their message -- ambiguous at best -- will be ignored. If such things as this are upheld in court, it tends to justify those people who "go postal". It doesn't matter what courts say; people can discern injustice.
