CD rights vs. digital rights[ Reply to This ] (none / 0) (#7)

Reading the posting by Fred von Lohmann, I notice that he talks about the EULA restrictions on digital copies of the CD. However, if you have a Mac or Linux box, or you have windows auto-run disabled, the Sony software wouldn't run and you wouldn't see or agree to the EULA. Nor would you access the Windows DRM protected tracks on the CD. Then what rights do you have with respect to digital copies you may make of the CDA music tracks on the CD? Also, what if you make an analog copy of the music (e.g. play it back into a VCR to record a new audio track over a video) - what rights do you have then? What if you make an analog copy and then rip that analog copy to digital?

does the EULA apply to the CDA, or just WMA data?[ Parent | Reply to This ] (none / 0) (#11)

I would assume that the EULA is related to the WMA tracks on the cd, since you encounter no EULA if you don't 'run' the cd. If you were to bypass autorun, you would be playing the CDA audio, and therefore the EULA wouldn't have any weight. (IMHO)
