Okay, the Spam Arrest EULA is over the top with it's $2000 per "violation", but is it any different than what some readers here have proposed for their own "personal EULA" designed to stop companies from spamming them? Few of your readers would complain if a major spamming company agreed to the EULA and then was presented with a huge bill for violating it, and it's pretty clear what would constitute a violation of the EULA even if you don't read the CANSPAM act.

The purpose of Spam Arrest is to stop unsolicited commercial email, and the challenge-response is obviously intended for friends of the people who use the service to be able to send them email, not spam. I probably wouldn't agree to it either, just out of spite, but really it's not that big a deal.
