This type of business practice is only tolerated because people put up with it. Fill out a complaint with you State Attorney Generals office. Have them investigate. If you paid the money for the new disks on you credit card as well as the original software, dispute the charge and write your card company. Let them defend their actions. What is next, does the new software allow them to deactivate it unless you start paying $5.99 a month.

This is how software used to work in the 60's and 70's, and is where Microsoft wants us to go today (to paraphrase their ad campaign).

It has been written that Microsoft tried to implement this feature on Windows XP and Office XP - it was to have taken effect in October 2002. However, many corporate customers complained (quietly) to his Billness, and Microsoft chose to hold off ... for now.

Why do you think Microsoft implemented product activation starting with those two products along with Microsoft Passport, the repository of your username, password, and financial (banking and credit card) info?

It has been written that the original idea was to have everyone require a MS Passport, and then, with a EULA change on the website, begin charging your credit card or EFT a fee of $12.95 per month for Windows XP and a fee of $7.95 per month for Office XP.

Sources indicate that Microsoft has inferred that they WILL begin this process in 2006, corporate America be damned.

So, enjoy that illusion of software ownership ... for now!

Neither will constesting you [sic] credit card company as federal law allows only a time period of 30 days after purchase to contest those charges. If you reread this case you see that the original purchase of the software occurred over a year ago.

Not quite true. As a former avid ebayer, the limit on chargebacks is a minimum of 60 days, with some extending it to 90-120. As well as having to be over $50 in most cases.

This cannot be true. If you purchase an item on the 1st day of your billing cycle, your bill won't be printed for another 28-30 days, plus a few days for it to be mailed and reach you. You may not see a credit card invoice containing a particular purchase for well over 30 days of the purchase date. The minimum almost has to be at least 60 days.

The 30-day limitation is not correct. I think the actual time period is defined as 60 days from the day you first receive the statement with the charge on it. That's the minimum time frame you have to request a chargeback. Many card issuers are more flexible than that; I suspect for cardholders they value the most, they'd be much more accomadating with chargeback requests.

I did a chargeback with AMEX a couple years ago, they sent a survey a few weeks after the process was done. One of the questions was would you have closed your AMEX account if the chargeback request was declined? I answered yes.

I'm sure MS would love to do this, but I have my doubts. There have been more than a few cases where large organizations (governments and corps.) strongly considered moving to Linux and not renewing their MS volume license agreements. In many cases, MS offered huge discounts to keep them as customers. In other cases, MS still lost them as customers, and they went to Linux. If MS was to actually implement a monthly/annual fee, and require activation from large corporate customers, I suspect we'd see more than a few of them loudly protesting, and begin switching to Linux. Or, they'd simply continue to use their older versions of Windows. Many organizations still run NT4, despite the pressure from MS to upgrade.

At least the new charge of $5.99 could be put into dispute, with the buyer demanding that Broderbund prove that they had the 90 day limit when he made the original purchase. How hard is Broderbund going to fight over $5.99? Also no matter what your credit card bank may tell you, chargebacks can be done 6 months or even a year later at the bank's discretion. Amex is the best credit card to use, you just tell them on the phone to open a dispute.
