I think the presence of various DRM mechanisms raise issues beyond what is covered here. Many of these mechanisms include features that "phone home" or probe the local network, often with some regularity. Companies that fail to include their intended use of the consumer's network in the EULA should lose a few points. In today's world, unexpected traffic on an unusual port is cause for concern. It would be a simple matter for companies using "phone home" mechanisms to provide enough information to identify the network traffic they generate.

Why put this into the EULA? Because allowing the vendor specific network traffic is as much a part of the agreement as allowing the vendor to audit license compliance. As a consumer, I don't want to deal with this, but if it is going to happen, the terms should be spelled out very clearly.
