This CAN-SPAM act is heading down the same path as the "Lets Ban Firearms" is Washington DC. I am not a gun toting fanatic, but look at some of the laws our government has passed and this law should not surprise anyone. Spam will definitely get worse and not much can be done. As with that gun ban in DC, the crimes involving guns is much higher then it was before. Why? Criminals will still buy guns on the black market regardless of the laws. As for spam, the serious offenders will still keep sending spam without regard to the CAN-SPAM laws. Why should they stop? If their clients can not be held liable for the actions of the spammers, then there is no real reason for anyone to stop using them. Obviously conceiling, forging and spoofing headers work. If it didn't, then the spammers would be easy to track down and deal with. I don't know about any of you, but I have not seen a decrease in porn and commercial spam in my inbox since the law went into effect. I have noticed that only a handfull of the commercial spam are starting to include "CAN-SPAM" complient information. 90% of the spam I still receive would be classified illegal by the CAN-SPAM law. Can the CAN-SPAM law work? Not unless the government is willing to spend millions of dollars tracking down the scum and properly dealing with them. How about public executions for the worst offenders (Drawn and Quartered). Maybe that would help deture the spammers.
