If these are so unenforcable, then some of these book/magazine companies and the like have GOT to start benchmarking the listed products annd publish the results EVERYWHERE, books, magazines, the Web, TV, Radio, etc. THEN a case can go to court to make it officially unenforcable.... Welcome to the next level of Corporate America, goverment .. Of the Rich, By the Rich, for the Rich.

Actually, you don't have to agree to the EULA. Copyright law allows for making copies to REVIEW or CRITIQUE a copyrighted work, or for EDUCATIONAL purposes.

So, copy someone's disk (EULA REMOVED) and run your benchmark, publish it and remove the software when done. You can CRITIQUE the software, provide EDUCATIONAL VALUE to others and still not agree to the stinking EULA at the same time.

Please site statutes and court cases (with docket numbers) to support this conclusion. I pray you are right, but it would be nice to have a good, hard precedent to use against this "gag" nonsense. We just need you to source your assertions (he said, hoping they are true...)
