So in other words, say we have a shop that is large enough to have a front office. Joe Worker out in the shop says he needs one, so Frank Purchaser goes out and buys the jig. Whoops! Frank Purchaser (being the bloke that actually bought the jig) is now the only one allowed to use it, but lo and behold, Frank is an accountant, not a woodworker. So much for THAT investment...

Frank Purchaser was acting as agent for Joe Worker.

For an easy analogy, imagine you're at a store and you someone in a wheelchair pay for an item at a store by taking the money and handing it to the cashier. You didn't buy the item, you facilitated the purchase.

There are enough problems with this idea of licensing tangile products; we really don't need to invent any. And

Dogs make copies of themselves. Will pet shops "license" puppies next?
Not to be confused with dog licenses, which is license in the sense of "a tax or right to own", not "restriction on use".

Don't know about pet shops, but breeders have been doing this for years. When you buy a dog with a pedigree, one of two "licenses" are available. One gives the dog the right to reproduce and have its offspring pedigreed, the other does not. The more restrictive version is less expensive.

the dogs can have pups, you just cant sell the pups as purebreeds (as you are not allowed to register for the papers on the offspring if restricted by the original)

you can't purchase the product, only a license to use the product; additionaly you can't use the product if you didn't purchase the product that you can't purchase so nobody can legaly use the product!

As someone on Slashdot pointed out.. if the jig can be used to create a duplicate of itself, then the loophole is here:

"you may not allow individuals that did not purchase the original Product (to) use the Product or any templates produced using the Product"

The original purchaser makes a template copy of the original (since s/he's the only one allowed to use it), then takes the copy and uses it (being a template off the original, also has to be done by the purchaser) to create a second-generation copy that can then be given to anyone. The second gen copy came from the first copy, not "the Product", and is therefore not bound by restrictions that come from producing items with the original.
